BILL NUMBER: S5299 TITLE OF BILL : An act to amend the mental hygiene law, in relation to the confidentiality of clinical records PURPOSE OF THE BILL To enable the Medical Review Board of the State Commission of Correction to obtain the clinical records of mental health patients who are inmates in correctional facilities. SUMMARY OF PROVISIONS : Section 1 of the bill would amend section 33.13(cX5) of the Mental Hygiene Law to provide that the Medical Review Board of State Commission of Correction may, in carrying out its statutory functions, powers and duties, obtain the clinical records of mental health patients who are inmates of a correctional facility. Section 2 of the bill would make it effective immediately. JUSTIFICATION : The Medical Review Board of the State Commission of Correction is tasked with investigate all inmate deaths. ORTT -- (at request of the State Commission of Correction) -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Developmental Disabil- ities AN ACT to amend the mental hygiene law, in relation to the confidential- ity of clinical records THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph 5 of subdivision (c) of section 33.13 of the mental hygiene law, as amended by chapter 912 of the laws of 1984, is amended to read as follows: 5. to the medical review board of the state commission of correction when such board has requested such information with respect to the death of a named person, or[, with the consent of a patient or client] when such board has requested information about the patient or client provid- ing that such board requires such information in the exercise of its statutory functions, powers and duties. Information, books, records or data which are confidential as provided by law shall be kept confiden- tial by the commission and any limitation on the release thereof imposed by law upon the party furnishing the information, books, records or data shall apply to the medical review board. § 2.
