BILL NUMBER: S5654 TITLE OF BILL : An act to amend the administrative code of the city of New York, in relation to the licensing of establishments providing adult entertainment PURPOSE : The purpose of this bill is to bring into the regulatory framework those adult entertainment establishments in the City of New York that have lewd or indecent entertainment performed or condoned but which do not have licenses to sell alcoholic beverages or which such license to serve alcoholic beverages has been revoked. SUMMARY OF PROVISIONS : Section 1: Amends the Administrative Code of the City of New York section 20-359 (3) which relates to the regulation of "cabaret" establishments. This provision creates a new Class B Cabaret license. Such establishments that do not serve alcoholic beverages, but provide entertainment or amusement that is lewd or indecent in nature or which permits the exposure for view any private parts of the human body must obtain a Class B cabaret license. Currently these establishments that are not licensed by the State Liquor Authority and cannot be supervised by the City of New York.

KLEIN -- read twice and ordered printed, and when printed to be committed to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to the licensing of establishments providing adult enter- tainment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 20-359 of the administrative code of the city of New York, as amended by local law number 34 of the city of New York for the year 1986, is amended to read as follows: 3. "Cabaret." (A) CLASS A CABARET: Any room, place or space in the city in which any musical entertainment, singing, dancing or other form of amusement is permitted in connection with the restaurant business or the business of directly or indirectly selling to the public food or drink, except eating or drinking places, which provide incidental musical entertainment, without dancing, either by mechanical devices, or by not more than three persons. (B) CLASS B CABARET: ANY ROOM, PLACE OR SPACE IN THE CITY, WHICH IS NOT LICENSED TO SELL ALCOHOLIC BEVERAGES, IN WHICH ANY ENTERTAINMENT OR OTHER FORM OF AMUSEMENT IS PERMITTED IN CONNECTION WITH A BUSINESS WHEN SUCH ENTERTAINMENT OR AMUSEMENT INCLUDES (I) ANY LEWD OR INDECENT CONDUCT PERFORMED BY ANY PERSON EMPLOYED BY, INDEPENDENT CONTRACTOR OF OR PATRON OF SUCH BUSINESS, OR (II) ANY PERSON EMPLOYED BY, INDEPENDENT CONTRACTOR OF OR PATRON OF SUCH BUSINESS APPEARING UNCLOTHED OR IN SUCH MANNER OR ATTIRE AS TO EXPOSE TO VIEW ANY PORTION OF THE PUBIC HAIR, ANUS, VULVA, GENITALS, AREOLA OR ANY SIMULATION THEREOF. § 2. The administrative code of the city of New York is amended by adding a new section 20-359.1 to read as follows: § 20-359.1 CLASS B CABARETS. THE DEPARTMENT SHALL ESTABLISH A SPECIFIC LICENSE FOR CLASS B CABARETS, WHICH SHALL BE ISSUED PURSUANT TO THIS SUBCHAPTER. EVERY CLASS B CABARET SHALL BE SUBJECT TO ALL PROVISIONS OF EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
