BILL NUMBER: S5683 TITLE OF BILL : An act to amend the public health law and the state finance law, in relation to the provision of family planning services; and making an appropriation therefor PURPOSE OR GENERAL IDEA OF BILL : Establishes a contingency fund to reimburse providers for family planning services in case of the elimination or reduction of federal funding for family planning services. SUMMARY OF SPECIFIC PROVISIONS : Section 1 of the bill creates a new title in the Public Health Law entitled Funding of Family Planning Services. This new title authorizes the Commissioner of Health to provide grants to providers of family planning services in an amount equal to the loss of federal funding for family planning services. The Commissioner of Health would approve applications for funding from qualified organizations. Section 2 amends the state finance law to create a family planning services contingency fund managed by the State Comptroller. Section 3 authorizes the appropriation of $35 million to the family planning services contingency fund.

PERSAUD -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the public health law and the state finance law, in relation to the provision of family planning services; and making an appropriation therefor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 25 of the public health law is amended by adding a new title 7 to read as follows: TITLE 7 FUNDING OF FAMILY PLANNING SERVICES SECTION 2595. FUNDING OF FAMILY PLANNING SERVICES; REDUCTION OR ELIMI- NATION OF FEDERAL FUNDS. § 2595. FUNDING OF FAMILY PLANNING SERVICES; REDUCTION OR ELIMINATION OF FEDERAL FUNDS. 1. THE COMMISSIONER, IN THE EVENT OF THE REDUCTION OR ELIMINATION OF FEDERAL FINANCIAL PARTICIPATION THROUGH THE MEDICAL ASSISTANCE PROGRAM, FEDERAL TITLE X FUNDS OR OTHER FEDERAL FUNDS RELATED TO THE PROVISION OF FAMILY PLANNING SERVICES, SHALL PROVIDE GRANTS TO PROVIDERS OF FAMILY PLANNING SERVICES IN THE STATE INCLUDING, BUT NOT LIMITED TO, PLANNED PARENTHOOD FACILITIES. SUCH GRANTS SHALL BE AWARDED UPON APPLICATION SUBMITTED AND APPROVED BY THE COMMISSIONER IN THE AMOUNT EQUAL TO THE FEDERAL FUNDING FOR FAMILY PLANNING SERVICES OF WHICH THE APPLICANT WAS DEPRIVED AS THE RESULT OF SUCH REDUCTION OR ELIMINATION. GRANTS SHALL ONLY BE PROVIDED PURSUANT TO THIS SECTION TO APPLICANTS WHICH HAVE BEEN CERTIFIED BY THE DIRECTOR OF THE BUDGET TO HAVE LOST FEDERAL FUNDING FOR FAMILY PLANNING SERVICES. 2. THE COMMISSIONER SHALL PROMULGATE SUCH RULES AND REGULATIONS AS HE OR SHE SHALL DEEM NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS SECTION. § 2. The state finance law is amended by adding a new section 85 to read as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
