BILL NUMBER: S5797 TITLE OF BILL : An act to amend the navigation law, in relation to requiring working carbon monoxide detectors to be carried on closed bow boats PURPOSE : To prevent needless deaths and carbon monoxide poisonings of boat owners and their guests while boating. SUMMARY OF PROVISIONS : Paragraph 9-a of Section 40 of the navigation law is amended to read, "Carbon monoxide detectors. All vessels with a closed bow shall carry a working carbon monoxide detector on board." JUSTIFICATION : Carbon monoxide is an odorless, colorless gas that is produced whenever any such fuel as gasoline is burned. Carbon monoxide from boat engines can build up in an enclosed or semi-enclosed spaces and create poisoning hazards. Often called the silent killer because early signs of poisoning are ignored or the person breathing in the toxin can lose consciousness and be unable to escape the danger. FOR THE PURPOSE OF THIS SECTION, AN "ENCLOSED ACCOMMODATION COMPARTMENT" MEANS ONE CONTIGUOUS SPACE, SURROUNDED BY BOAT STRUCTURE THAT CONTAINS ALL OF THE FOLLOWING: (I) DESIGNATED SLEEPING ACCOMMODATIONS; (II) A GALLEY AREA WITH SINK; AND (III) A HEAD COMPARTMENT. (B) AFTER THE EFFECTIVE DATE OF THIS SUBDIVISION, NO NEW VESSEL THAT HAS AN ENCLOSED ACCOMMODATION COMPARTMENT MAY BE SOLD OR OFFERED FOR SALE IN THE STATE UNLESS SUCH VESSEL IS EQUIPPED WITH A NEW FUNCTIONING CARBON MONOXIDE DETECTION SYSTEM INSTALLED ACCORDING TO THE MANUFACTUR- ER'S INSTRUCTIONS. § 2.
