BILL NUMBER: S5819 TITLE OF BILL : An act authorizing the alienation of certain parklands in the town of Hempstead, county of Nassau PURPOSE : To alienate parkland that was dedicated as such in 1921, but was never used as parkland. SUMMARY OF PROVISIONS : Section 1 authorizes Nassau County to alienate and sell the land. Section 2 requires Nassau County to dedicate an equal amount of land at an equal value in order to act on Section 1 of the bill. Section 3 describes the relevant parkland and specifies acreage and borders. Section 4 requires Nassau County's compliance with federal statutes regarding the alienation of this parkland. KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT authorizing the alienation of certain parklands in the town of Hempstead, county of Nassau THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subject to the provisions of this act, the town of Hemp- stead, in the county of Nassau, acting by and through its governing body, is hereby authorized to discontinue as parklands and alienate the lands more particularly described in section three of this act, and to sell and convey such parklands at fair market value and upon such other terms and conditions as determined by the governing body of the town of Hempstead to Mott Development, Inc. § 2. The authorization provided in section one of this act shall be effective only upon the condition that the town of Hempstead shall dedi- cate the lands described in section four of this act as additional park- land of the town. § 3. The lands authorized by section one of this act to be discontin- ued as parklands and conveyed by the county of Nassau are described as follows: ALL that certain plot, piece or parcel of land, situate, lying and being at Oceanside in the Town of Hempstead, County of Nassau and State of New York, containing approximately two acres of bounded and described as follows:- BEGINNING at the Northwest corner thereof at a point formed by the intersection of the highwater mark on the Southerly bank of Bedell Creek with a line drawn parallel to an old fence now standing on the Easterly line of land of one Bristol and distant Fifty (50) feet Easterly there- from, and running thence Southerly in direct continuation of said line to the old fence on the Southerly side of Mott Street, or Bayview Avenue; thence Easterly and in a straight line with and part of the EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

Notwithstanding section 2 of chapter 325 of the laws of 1920, subject to the provisions of this act, the town of Hempstead, in the county of Nassau, acting by and through its governing body and upon such terms and conditions as determined by such body, is hereby author- ized to discontinue as parklands and to sell and convey at fair market value the lands described in section three of this act, to Mott Develop- ment for the purpose of providing necessary land for the construction of planned residential structures. § 2. The authorization provided in section one of this act shall be effective only upon the condition that the town of Hempstead shall dedi- cate the lands described in section four of this act as parkland provided that the town has never used such lands for public open space or park purposes. § 3. The parklands authorized by section one of this act to be alien- ated are described as follows: All that piece or parcel of property situated in Oceanside, Town of Hempstead, County of Nassau and State of New York shown as Section 54 Block 322 Part of Lot 15 on the Nassau County Land the Tax Map and being more particularly described as follows: EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
