BILL NUMBER: S5880 TITLE OF BILL : An act to amend the public authorities law, in relation to authorizing the Westchester health care corporation to enter into agreements for the creation and operation of a health care delivery system network PURPOSE : To clarify that Westchester Health Care Corporation (WHCC) may exercise its general and special powers regardless of whether such exercise might have an impact on competition. SUMMARY OF PROVISIONS : Section one adds a new subdivision 8 to section 3306 of the Public Authorities Law to clarify that in carrying out its health care purposes, WHCC may engage in certain collaborative activities. This provision provides the necessary legislative declaration for the activities of WHCC, and of the private entities and individuals with which it collaborates, to be immunized from liability under federal and state antitrust laws. Section two establishes the effective date.

AS SET FORTH IN SECTION THIRTY-THREE HUNDRED ONE OF THIS TITLE, THE CREATION AND OPERATION OF THE CORPORATION IS FOR THE BENEFIT OF THE RESIDENTS OF THE STATE OF NEW YORK AND THE COUNTY, INCLUDING PERSONS IN NEED OF HEALTH CARE SERVICES WITHOUT THE ABILITY TO PAY, AND IS A STATE, COUNTY AND PUBLIC PURPOSE. THE CORPORATION HAS ADVISED THAT IT INTENDS TO ENGAGE IN CERTAIN COLLABORATIVE ACTIVITIES WITH AND LIMITED TO, HEALTH CARE PROVIDERS IN THE SEVEN LOWER HUDSON VALLEY COUNTIES OF WEST- CHESTER, ROCKLAND, DUTCHESS, ORANGE, ULSTER, PUTNAM AND SULLIVAN, AS SET FORTH IN SECTION THIRTY-THREE HUNDRED ONE OF THIS TITLE, FOR THE PURPOSE OF PROMOTING IMPROVED QUALITY OF AND ACCESS TO HEALTH CARE SERVICES AND IMPROVED CLINICAL OUTCOMES, CONSISTING OF: (A) DEVELOPMENT OF A NON-EX- CLUSIVE JOINT HEALTH INFORMATION TECHNOLOGY PLATFORM; (B) JOINT MARKET- ING OF HEALTH CARE SERVICES; (C) DEVELOPMENT OF A JOINT SET OF CLINICAL QUALITY STANDARDS; (D) COORDINATION AND INTEGRATION OF CLINICAL SERVICE TO REDUCE REDUNDANCY AND INCREASE EFFICIENCY; (E) JOINT DISCUSSIONS WITH RURAL HOSPITALS REGARDING THE POSSIBILITY OF COORDINATING AND INTEGRAT- ING CLINICAL SERVICES; AND (F) JOINT PURCHASING OF SERVICES, SUPPLIES AND EQUIPMENT RELATED TO THE PROVISIONS OF HEALTH CARE SERVICES.
