BILL NUMBER: S6032 TITLE OF BILL : An act to amend the navigation law, in relation to the placement of navigational aids adjacent to real property designated as "Coney Island" PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to protect swimmers from motorized boats and jetskis that SUMMARY OF SPECIFIC PROVISIONS : This bill would amend Subdivision 2 of section 35 of the navigation law, as amended by chapter 659 of the laws of 1990, to allow for the requirement of placing aids to navigation in the navigable waters adjacent to all real property designated as "Coney Island" including Brighton Beach. JUSTIFICATION : Swimmers swimming in beaches in Coney Island and Brighton Beach are at risk of being injured by small boats and jet skis that are prevalent in the area, particularly in the summer months. SAVINO -- read twice and ordered printed, and when printed to be committed to the Committee on Cultural Affairs, Tourism, Parks and Recreation AN ACT to amend the navigation law, in relation to the placement of navigational aids adjacent to real property designated as "Coney Island" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 35 of the navigation law, as amended by chapter 659 of the laws of 1990, is amended to read as follows: § 35. Aids to navigation. 1. The commissioner may authorize, through the issuance of a revocable permit, the placing of aids to navigation in the navigable waters of the state, and any tidewaters bordering on or lying within the boundaries of Nassau and Suffolk counties, to mark obstructions to navigation, or for any other purpose, if, in his judg- ment, it will promote safety of navigation. Any person interested in the navigation of the navigable waters of the state, and any tidewaters bordering on or lying within the boundaries of Nassau and Suffolk coun- ties, who may desire to place such aids to navigation therein, without expense to the state, may make application to the commissioner and submit a map suitable for blue print reproduction showing the proposed location of such aids to navigation and their color and meaning. The commissioner shall make rules and regulations establishing the size, shape, color and significance of such aids to navigation. When authori- zation has been granted the said aids to navigation shall be deemed lawfully placed. If, in the judgment of the commissioner, aids to navi- gation authorized by him are found to be improperly placed or that the reason for their placement no longer exists, he may revoke the permit authorizing their placement by written notice mailed to the person to whom the permit was issued directing their removal within a specified time. BILL NUMBER: S6032A TITLE OF BILL : An act relating to the placement of navigational aids adjacent to real property designated as "Coney Island" PURPOSE OR GENERAL IDEA OF BILL : The purpose of this bill is to protect swimmers from jet skis. SUMMARY OF PROVISIONS : This bill would authorize the Commissioner of the Office of Parks, Recreation and Historic Preservation to install navigational devices marking 500 feet from any designated bathing beach in Coney Island to deter personal watercraft. JUSTIFICATION : Swimmers swimming in beaches in Coney Island and Brighton Beach are at risk of being injured by jet skis that are prevalent in the area, particularly in the summer months. In order to protect swimmers and those driving personal watercraft, aids to navigation should be placed five hundred feet from the shoreline, creating a safety zone between such aids and the shoreline, in which no personal watercraft shall be

The commissioner, as defined in subdivision two of section two of the navigation law, in order to deter violations of paragraph f of subdivision one of section 73-a of the navigation law, by personal watercraft, may, through the issuance of a revocable permit, authorize the placing of aids to navigation within five hundred feet of any desig- nated bathing area adjacent to all real property designated as "Coney Island." Any personal watercraft operator found to be operating within the area between the bathing beach and the navigational aid shall be subject to the penalties provided in subdivision three of section 73-a of the navigation law. § 2.
