BILL NUMBER: S6035 TITLE OF BILL : An act to amend the public health law, in relation to death certificates for persons whose death is caused by an opioid overdose PURPOSE : Requires that when a person dies from an opioid overdose the death certificate must include the specific opioid that caused the death. SUMMARY OF PROVISIONS : Section one amends the public health law to require that a death certificate include the specific opioid (if ascertainable) that caused the death of the individual. JUSTIFICATION : According to a 2014 analysis done by the Centers for Disease Control and Prevention (CDC), there were over 28,000 opioid overdose deaths in the U.S, including from prescription painkillers and heroin. This represents a one-year increase of 14%. The same report also analyzed the percentage of death certificates that listed the specific drugs involved in an opioid overdose. New York State ranked 13th in the nation falling behind neighboring states such as Connecticut,

BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to death certificates for persons whose death is caused by an opioid overdose THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 4 of section 4141 of the public health law, as amended by chapter 153 of the laws of 2011, is amended to read as follows: (d) Where a death is caused by an opioid overdose, such information shall be indicated ON THE CERTIFICATE, including, IF ASCERTAINABLE, THE SPECIFIC OPIOID THAT CAUSED THE DEATH OF THE DECEDENT, ALONG WITH any OTHER related information as the commissioner may require. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD11570-01-7
