BILL NUMBER: S6255 TITLE OF BILL : An act to amend chapter 57 of the laws of 2017, amending the public health law relating to reserved bed days, in relation to the effective date of certain provisions thereof PURPOSE : To clarify the intended effective date for the change to New York State's reserve bed day reimbursement methodology and clarify that nursing homes may continue to bill Medicaid for hospital leaves of absence until the later of September 1, 2017 or when the Department of Health adopts final amendments to existing bed hold regulations. SUMMARY OF PROVISIONS : Section 1 of the bill amends section 7 of Part E of Chapter 57 of the Laws of 2017 to provide a September 1, 2017 effective date, provided that the Department of Health must adopt final amended regulations before this section of law takes effect. HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend chapter 57 of the laws of 2017, amending the public health law relating to reserved bed days, in relation to the effective date of certain provisions thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 7 of part E of chapter 57 of the laws of 2017, amending the public health law relating to reserved bed days, is amended to read as follows: § 7. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 1, 2017; EXCEPT THAT SECTION TWO OF THIS ACT SHALL TAKE EFFECT ON THE FIRST OF SEPTEMBER AFTER THIS ACT SHALL HAVE BECOME A LAW; PROVIDED THAT PRIOR TO THE EFFECTIVE DATE OF SECTION TWO OF THIS ACT THE COMMISSIONER OF HEALTH SHALL AMEND EXISTING REGULATIONS AND TAKE OTHER ACTIONS REASONABLY NECESSARY TO IMPLEMENT THE CHANGE TO THE RESERVED BED DAY POLICY AND REIMBURSEMENT METHODOLOGY AS AMENDED BY SECTION TWO OF THIS ACT; AND PROVIDED FURTHER THAT THE DEPARTMENT OF HEALTH SHALL NOT DENY REIMBURSE- MENT FOR BEDS RESERVED PURSUANT TO SECTION 2808 OF THE PUBLIC HEALTH LAW AND REGULATIONS EXISTING ON OR BEFORE APRIL 1, 2017, UNLESS AND UNTIL THE COMMISSIONER OF HEALTH ISSUES AMENDED REGULATIONS TO REFLECT THE PUBLIC HEALTH LAW CHANGES MADE BY THIS ACT. § 2. This act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 1, 2017.
