BILL NUMBER: S6316 TITLE OF BILL : An act to amend the environmental conservation law, in relation to illegal dumping local enforcement grants PURPOSE : This bill would direct the Department of Environmental Conservation to implement a grant program that assists local enforcement efforts to combat illegal dumping. SUMMARY OF PROVISIONS : Section one directs the Commissioner of the Department of Environmental Conservation to implement an illegal dumping enforcement grant program that provides up to $25,000 to localities to abate illegal dumping activity. Section two provides for eligible expenses under the grant program. Section three requires the Commissioner, in cooperation with the Division of State Police, to provide technical expertise and other guidance to grantees. Section four provides for community disclosure in instances where surveillance cameras are installed at known dumping sites.

BROOKS, KAMINSKY -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to ille- gal dumping local enforcement grants THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 27-0111 to read as follows: § 27-0111. ILLEGAL DUMPING LOCAL ENFORCEMENT GRANTS. 1. THE COMMISSIONER IS AUTHORIZED TO CONTRACT TO MAKE A STATE GRANT, WITHIN THE LIMIT OF APPROPRIATION THEREFOR, TO LOCAL POLICE AGENCIES IN CONJUNCTION WITH ANY MUNICIPAL AGENCY HAVING AUTHORITY OVER LOCAL SANI- TIZATION OR WASTE MANAGEMENT FOR UP TO NINETY PERCENT OF THE COSTS TO MITIGATE ILLEGAL DUMPING, NOT TO EXCEED TWENTY-FIVE THOUSAND DOLLARS FOR EACH RECIPIENT IN A FISCAL YEAR. 2. ELIGIBLE COSTS MAY INCLUDE, BUT SHALL NOT BE LIMITED TO: (A) THE PURCHASE AND INSTALLATION OF SURVEILLANCE CAMERAS TRAINED ON KNOWN ILLEGAL DUMPING SITES; (B) PERSONAL AND NON-PERSONAL SERVICE COSTS ASSOCIATED WITH CONDUCTING STING OPERATIONS AT KNOWN ILLEGAL DUMPING SITES; AND (C) ILLEGAL DUMPING LOCATION SURVEYS, MAPPING AND OTHER INVESTIGATORY DATA COLLECTION. 3. THE COMMISSIONER, IN COOPERATION WITH THE DIVISION OF STATE POLICE, SHALL PROVIDE TECHNICAL EXPERTISE TO GRANT AWARDEES TO IMPLEMENT STAND- ARDS OF EVIDENCE AND PROSECUTION, DEVELOP STRATEGIES TO COMBAT ILLEGAL DUMPING USING SURVEILLANCE CAMERAS AND STING OPERATIONS, AND DEVELOP GUIDELINES TO PROTECT PERSONAL PRIVACY WHILE CARRYING OUT ACTIVITIES FUNDED THROUGH LOCAL ILLEGAL DUMPING ENFORCEMENT GRANTS. 4. WHERE SURVEILLANCE CAMERAS ARE INSTALLED, LOCAL POLICE AGENCIES OR MUNICIPAL AGENCIES RECEIVING GRANT FUNDING SHALL NOTIFY, IN WRITING, ALL EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
