BILL NUMBER: S6359 Revised 1/18/18 SPONSOR: LANZA TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to prohibiting the parking of a vehicle greater than sixty inches in height within fifteen feet of an intersection PURPOSE: To ensure a clear, unblocked view for drivers entering an intersection and lessening the likelihood of an accident occurring due to obstructed view of the intersection. SUMMARY OF PROVISIONS: Section one of the bill adds paragraph 4 to subdivision a of § 1202 of the vehicle and traffic law to prohibit an individual from parking a vehicle within fifteen feet of an intersection, whether occupied or not, except temporarily for loading or unloading passengers or merchandise, if the aforementioned vehicle is greater than sixty inches in height. LANZA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to prohibiting the parking of a vehicle greater than sixty inches in height within fifteen feet of an intersection THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (a) of section 1202 of the vehicle and traffic law is amended by adding a new paragraph 4 to read as follows: 4. A. PARK A VEHICLE, WHETHER OCCUPIED OR NOT, EXCEPT TEMPORARILY FOR THE PURPOSE OF AND WHILE ACTUALLY ENGAGED IN LOADING OR UNLOADING MERCHANDISE OR PASSENGERS, WITHIN FIFTEEN FEET OF THE NEAREST INTER- SECTION WHERE THE VEHICLE PARKED IS GREATER THAN SIXTY INCHES IN HEIGHT. B. ANY VEHICLE PARKED IN VIOLATION OF THIS PARAGRAPH SHALL BE SUBJECT TO PENALTIES SET BY THE LOCAL GOVERNING BODY WITH THE POWER TO ENACT SUCH SANCTIONS. C. NOTWITHSTANDING ANY OTHER PROVISION OF LAW TO THE CONTRARY, ANY MUNICIPALITY OF THIS STATE, ACTING THROUGH ITS LOCAL LEGISLATIVE BODY, IS HEREBY AUTHORIZED AND EMPOWERED TO ADOPT AND AMEND LOCAL LAWS, RULES AND ORDINANCES, IN ACCORDANCE WITH THE PROVISIONS OF THIS PARAGRAPH, IN ORDER TO IMPOSE A PENALTY FOR VIOLATING THIS PARAGRAPH, WHICH MAY INCLUDE, BUT NOT BE LIMITED TO, THE COST OF TOWING THE VEHICLE. § 2.
