BILL NUMBER: S6442 TITLE OF BILL : An act to amend the education law, in relation to incentivizing reductions in pupil transportation costs PURPOSE : This bill aims to incentivize reductions in pupil transportation costs by returning transportation savings to schools that have converted to a "walkable school model". SUMMARY OF SPECIFIC PROVISIONS : Section one: adds a new subdivision 7-a to section 3602 of the education law where the apportionment for pupil transportation shall include an amount for incentivizing reduction in pupil transportation costs, which shall be done once a school district can demonstrate a "walkable school model". Section two: sets the effective date. JUSTIFICATION : Studies show that when children walk or bike to school, versus long bus rides, they are more alert in class and less inclined toward obesity, it derives significant financial savings to the State and

JACOBS -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to incentivizing reductions in pupil transportation costs THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 3602 of the education law is amended by adding a new subdivision 7-a to read as follows: 7-A. APPORTIONMENT FOR INCENTIVIZING REDUCTION IN PUPIL TRANSPORTATION COSTS. IN ADDITION TO THE FOREGOING APPORTIONMENT, THERE SHALL BE APPOR- TIONED TO ANY SCHOOL DISTRICT FOR PUPIL TRANSPORTATION, AN AMOUNT BASED ON THE DIFFERENCE BETWEEN THE CURRENT TOTAL ANNUAL ALLOWABLE MILEAGE, AS DEFINED IN SECTION THIRTY-SIX HUNDRED TWENTY-ONE OF THIS ARTICLE, AND THE HIGHEST TOTAL ANNUAL ALLOWABLE MILEAGE THE SCHOOL DISTRICT HAS HAD OVER THE PREVIOUS FIVE YEARS. THE AMOUNT OF SUCH APPORTIONMENT SHALL BE CALCULATED AS THE REDUCTION IN THE SCHOOL DISTRICT'S APPORTIONMENT FOR PUPIL TRANSPORTATION DUE TO THE REDUCTION IN TOTAL ANNUAL ALLOWABLE MILEAGE COMPARED TO THE APPORTIONMENT THE YEAR THE SCHOOL DISTRICT HAD ITS HIGHEST TOTAL ANNUAL ALLOWABLE MILEAGE OVER THE PREVIOUS FIVE YEARS FOR THE FIRST YEAR OF THE REDUCTION, HALF OF THE REDUCTION IN APPORTION- MENT IN THE SECOND YEAR OF THE REDUCTION, AND A QUARTER OF THE REDUCTION IN APPORTIONMENT IN THE THIRD YEAR OF THE REDUCTION. SUCH APPORTIONMENT SHALL BE USED ON COSTS ASSOCIATED WITH CONVERSION OF THAT SCHOOL DISTRICT TO A WALKABLE SCHOOL MODEL. § 2. This act shall take effect on the first of July next succeeding the date on which it shall have become a law. BILL NUMBER: S6442A SPONSOR: JACOBS TITLE OF BILL: An act to amend the education law, in relation to apportionment for certain school districts for lower allowable transportation expenses PURPOSE: This bill affords school districts the opportunity to return funding to the classroom through a Transportation Efficiency Plan. SUMMARY OF PROVISIONS: Section 1. Amends Subdivision 7 of section 3602 of the education law by creating an incentive apportionment for school districts who can demon- strate cost savings and efficiencies for transportation expenses. Subdivision 7 of section 3602 of the education law is amended by adding a new paragraph f to read as follows: F. IN ADDITION TO ANY OTHER APPORTIONMENT UNDER THIS SUBDIVISION, FOR THE TWO THOUSAND NINETEEN--TWO THOUSAND TWENTY SCHOOL YEAR AND THEREAFT- ER, A SCHOOL DISTRICT OTHER THAN A CITY SCHOOL DISTRICT IN A CITY HAVING A POPULATION OF ONE MILLION OR MORE INHABITANTS SHALL BE ELIGIBLE FOR AN INCENTIVE APPORTIONMENT WHERE SUCH DISTRICT CAN DEMONSTRATE TO THE COMMISSIONER COST SAVINGS AND EFFICIENCIES THAT RESULTS IN A LOWER ALLOWABLE TRANSPORTATION EXPENSE FOR THE BASE YEAR COMPARED TO THE YEAR PRIOR TO THE BASE YEAR; PROVIDED, HOWEVER, THAT SUCH SCHOOL DISTRICT MEETS THE REQUIREMENTS SET FORTH IN SUBPARAGRAPH THREE OF THIS PARA- GRAPH. (1) THE AMOUNT OF SUCH INCENTIVE APPORTIONMENT UNDER THIS PARAGRAPH SHALL BE EQUAL TO THE PRODUCT OF: (I) THE POSITIVE DIFFERENCE IN SUCH DISTRICT'S ALLOWABLE TRANSPORTA- TION EXPENSE FOR THE YEAR PRIOR TO THE BASE YEAR MINUS SUCH DISTRICT'S ALLOWABLE TRANSPORTATION EXPENSE FOR THE BASE YEAR; AND (II) TEN PERCENT. (2) THE COMMISSIONER SHALL BE AUTHORIZED TO APPROVE A CLAIM FOR AN INCENTIVE APPORTIONMENT UNDER THIS PARAGRAPH PROVIDED A SCHOOL DISTRICT CLAIMING AN INCENTIVE APPORTIONMENT SHALL HAVE IMPLEMENTED AN APPROVED TRANSPORTATION EFFICIENCY PLAN AND DOCUMENTED SUCH COST SAVINGS AND EFFICIENCIES IN ACCORDANCE WITH GUIDELINES ESTABLISHED BY THE COMMIS- EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
