                                 BILL NUMBER:  S6447

 TITLE OF BILL :  An act to amend chapter 329 of the laws of 2009,
amending the family court act and the social services law, relating to
removing special powers granted to the society for the prevention of
cruelty to children, in relation to the effectiveness of the
provisions thereof

 PURPOSE :

This bill will extend the operations for the Rockland Society for the
Prevention of Cruelty to Children for two years and the Erie County
Society for the Prevention of Cruelty of Children to December 31,
2017.

 SUMMARY OF SPECIFIC PROVISIONS :

Section one of the bill amends chapter 146 of the laws of 2015 to
extend the expiration for two years in relation to the Rockland County
SPCC and until December 31, 2017 with respect to the Erie County SPCC.

Section two sets forth an immediate effective date.

 JUSTIFICATION :

In 2009, the legislature disbanded all Society for the Prevention of

Cruelty of Children (SPCC) organizations in the state except two
chapters in Rockland County and Erie County. They were exempt from the
law because they both operate in a cooperative manner with local
governments.

Consistent with the planned phase-out of the function of the Erie
County SPCC, this bill extends the governing statutory authority for
said SPCC up until December 31, 2017, at which time the Erie County
Department of Social Services will have made the adjustments necessary
to provide those services previously carried out by the SPCC.

This bill also recognizes the continued efforts of the Rockland County
SPCC in assisting local police departments to prevent underage alcohol
and tobacco sales, by providing a two-year extension so that the
County's SPCC, which has provided an invaluable service for many
years, may continue to thwart such sales.

 AN ACT to amend chapter 329 of the laws of  2009,  amending  the  family
   court  act  and  the social services law, relating to removing special
   powers granted to the society for the prevention of cruelty  to  chil-
   dren, in relation to the effectiveness of the provisions thereof
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 14 of chapter 329 of the laws of 2009, amending the
 family court act and the  social  services  law,  relating  to  removing
 special  powers  granted to the society for the prevention of cruelty to
 children, as amended by chapter 146 of the laws of 2015, is  amended  to
 read as follows:
   §  14.  This  act  shall  take  effect  immediately; provided that the
 provisions of sections eight[,] AND ten [and thirteen] of this act shall
 expire August 11, [2017] 2019 AND SECTION THIRTEEN  OF  THIS  ACT  SHALL
 EXPIRE  DECEMBER 31, 2017, when upon such [date] DATES the provisions of
 such sections shall be deemed repealed.
   § 2. This act shall take effect immediately.
