BILL NUMBER: S6699 TITLE OF BILL : An act to amend the correction law, in relation to prohibiting county correction officers from dispensing medication using syringes or needles in jails to inmates PURPOSE : Adds a new subdivision 5 to section 505 of the Correction Law to provide that correction officers in local correctional facilities shall not dispense or administer medication using hypodermic syringes or hypodermic needles to inmates on the premises of a local correctional facility unless otherwise authorized by law to do so. SUMMARY OF PROVISIONS : Amends Correction law section 505 by adding a new subdivision 5 to prohibit correction officers in a local correctional facility from dispensing or administering medication using hypodermic syringes or hypodermic needles to inmates on the premises of a local correctional facility unless they are otherwise authorized to do so. JUSTIFICATION : Injecting medication into another person by syringe or needle in a local correctional should only be done by a qualified medical

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the correction law, in relation to prohibiting county correction officers from dispensing medication using syringes or needles in jails to inmates THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 505 of the correction law is amended by adding a new subdivision 5 to read as follows: 5. COUNTY CORRECTION OFFICERS IN LOCAL CORRECTIONAL FACILITIES SHALL NOT DISPENSE OR ADMINISTER MEDICATION USING HYPODERMIC SYRINGES OR HYPO- DERMIC NEEDLES TO INMATES ON THE PREMISES OF A LOCAL CORRECTIONAL FACIL- ITY AS DEFINED IN SUBDIVISION SIXTEEN OF SECTION TWO OF THIS CHAPTER, UNLESS THEY ARE OTHERWISE AUTHORIZED TO DO SO. THIS PROVISION SHALL NOT APPLY TO DISPENSING OF PILL-BASED MEDICATION TO INMATES. § 2. This act shall take effect immediately.
