TITLE OF BILL:  An act to amend the tax law and the social services
law, in relation to providing for the inclusion of a check off box on
personal income tax return forms for the purpose of making a gift to the
William B. Hoyt Memorial children and family trust fund

 
PURPOSE:

This bill provides for the inclusion of a check off box on personal
income tax forms for the purpose of making a gift to the William B. Hoyt
Memorial Children and Family trust fund for child abuse prevention.

 
SUMMARY OF PROVISIONS:

Section 1 amends the tax law by adding a new section 630-f: Effective
for any tax year commencing on or after January 1, 2017, an individual
in any taxable year may elect to contribute to the William B. Hoyt Memo-
rial children and family trust fund. Such contribution shall be in any
whole dollar amount and shall not reduce the amount of state tax owed by

such individual. The tax commission shall include space on the personal
income tax return to enable a taxpayer contribution. All revenues
collected from pursuant to this section shall be credited to the William
B. Hoyt Memorial children and family trust fund.

Section 2 amends the social services law to require a description of how
the funds collected were utilized during the preceding year.

Section 3 sets an immediate effective date.

 
JUSTIFICATION:

Under this bill taxpayers would have the option to support and strength-
en New York children and families by donating to the William B. Hoyt
Memorial Children and Family Trust Fund. Research shows that as the
number of adverse child experiences increase, the risk for numerous long
term health problems increases significantly.  Investing in prevention
can reduce the need for costly intervention services resulting from
abuse and maltreatment.  The William B. Hoyt Memorial Children and Fami-
ly Trust Fund is administered by the Office of Children and Families. In
2013, 27 programs received funding from the Trust Fund which helped over
167,554 adults and children in the state. The Trust Fund programs have
positive outcomes for individuals served, such as: improved factors that
protect against child abuse and neglect improved safety for children,
adults and elders exposed to family violence and reduced incidents of
Abusive Head Trauma (Shaken Baby Syndrome).

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The tax law is amended by adding a  new  section  630-f  to
 read as follows:
   §  630-F.  GIFT  FOR  THE WILLIAM B. HOYT MEMORIAL CHILDREN AND FAMILY
 TRUST FUND. EFFECTIVE FOR ANY TAX YEAR COMMENCING ON  OR  AFTER  JANUARY
 FIRST,  TWO  THOUSAND  SEVENTEEN,  AN INDIVIDUAL IN ANY TAXABLE YEAR MAY
 ELECT TO CONTRIBUTE TO THE WILLIAM B. HOYT MEMORIAL CHILDREN AND  FAMILY
 TRUST  FUND ESTABLISHED PURSUANT TO SECTION FOUR HUNDRED EIGHTY-ONE-F OF
 THE SOCIAL SERVICES LAW. SUCH CONTRIBUTION SHALL BE IN ANY WHOLE  DOLLAR
 AMOUNT  AND  SHALL NOT REDUCE THE AMOUNT OF STATE TAX OWED BY SUCH INDI-
 VIDUAL. THE TAX COMMISSION SHALL INCLUDE SPACE ON  THE  PERSONAL  INCOME
 TAX RETURN TO ENABLE A TAXPAYER TO MAKE SUCH CONTRIBUTION. NOTWITHSTAND-
 ING  ANY  OTHER PROVISION OF LAW ALL REVENUES COLLECTED PURSUANT TO THIS
 SECTION SHALL BE CREDITED TO THE WILLIAM B.  HOYT MEMORIAL CHILDREN  AND
 FAMILY TRUST FUND AND USED ONLY FOR THOSE PURPOSES ENUMERATED IN ARTICLE
 TEN-A OF THE SOCIAL SERVICES LAW.
   §  2.  Paragraphs (e) and (f) of subdivision 8 of section 481-e of the
 social services law, as amended by chapter 57 of the laws of  1985,  are
 amended to read as follows:
   (e)  a  description of the nature and quality of services provided and
 the impact upon the populations and communities served and their  poten-
 tial for being replicated elsewhere; [and]
   (f)  A DESCRIPTION OF HOW THE MONEYS OF THE FUND COLLECTED PURSUANT TO
 SECTION SIX HUNDRED THIRTY-F OF THE TAX LAW  WERE  UTILIZED  DURING  THE
 PRECEDING CALENDAR YEAR, INCLUDING INFORMATION CONCERNING:

  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
                       [ ] is old law to be omitted.

   (I)  THE  AMOUNT OF MONEY DISBURSED FROM THE FUND AND THE DISTRIBUTION
 PROCESS USED FOR SUCH DISBURSEMENTS;
   (II) RECIPIENTS OF THE EXPENSES FROM THE FUND;
   (III) THE AMOUNT ALLOTTED TO EACH;
   (IV) THE PURPOSES FOR WHICH SUCH DISTRIBUTIONS WERE GRANTED; AND
   (V) A SUMMARY FINANCIAL PLAN FOR SUCH MONIES WHICH SHALL INCLUDE ESTI-
 MATES OF ALL RECEIPTS AND ALL DISBURSEMENTS FOR THE CURRENT AND SUCCEED-
 ING FISCAL YEARS; AND
   (G)  all such other matters as may be necessary to inform the governor
 and the legislature regarding the implementation and evaluation  of  the
 effectiveness  of  programs  covered  by this section and the success of
 such programs in accomplishing the intent of the legislature.
   § 3. This act shall take effect immediately and  shall  apply  to  all
 taxable years commencing after January 1, 2017.

TITLE OF BILL:

An act to amend the tax law and the social services law, in relation to
providing for the inclusion of a check off box on personal income tax
return forms for the purpose of making a gift to the William B. Hoyt

PURPOSE:

This bill provides for the inclusion of a check off box on personal
income tax forms for the purpose of making a gift to the William B. Hoyt
Memorial Children and Family trust fund for child abuse prevention.

 
SUMMARY OF PROVISIONS:

Section 1 amends the tax law by adding a new section 630-f: Effective
for any tax year commencing on or after January 1, 2017, an individual
in any taxable year may elect to contribute to the William B. Hoyt Memo-

rial children and family trust fund. Such contribution shall be in any
whole dollar amount and shall not reduce the amount of state tax owed by
such individual. The tax commission shall include space on the personal
income tax return to enable a taxpayer contribution. All revenues
collected from pursuant to this section shall be credited to the William
B. Hoyt Memorial children and family trust fund.
