BILL NUMBER: S7633 SPONSOR: HAMILTON TITLE OF BILL: An act to amend the public housing law, in relation to the New York city housing authority performing lead paint inspections and hiring tenants to repaint apartments; and making an appropriation therefor PURPOSE: To address the lead paint crisis through transparency of inspections allowing for more effective oversight in mandating annual lead paint reports and to protect the general health and welfare of the people residing within the state by establishing a system for repainting. SUMMARY OF PROVISIONS: The public housing law is amended by adding a new section 402-d requir- ing the New York City housing authority to submit lead based paint reports on or before the first of December annually to the governor, temporary president of the senate, speaker of the Assembly and minority

HAMILTON -- read twice and ordered printed, and when printed to be committed to the Committee on Finance AN ACT to amend the public housing law, in relation to the New York city housing authority performing lead paint inspections and hiring tenants to repaint apartments; and making an appropriation therefor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public housing law is amended by adding a new section 402-d to read as follows: § 402-D. REPORTING ON LEAD BASED PAINT; REPAINTING OF APARTMENTS. 1. THE NEW YORK CITY HOUSING AUTHORITY SHALL SUBMIT AN ANNUAL LEAD BASED PAINT REPORT ON OR BEFORE THE FIRST OF DECEMBER OF EACH YEAR TO THE GOVERNOR, TEMPORARY PRESIDENT OF THE SENATE, SPEAKER OF THE ASSEMBLY, MINORITY LEADER OF THE SENATE AND THE MINORITY LEADER OF THE ASSEMBLY, INCLUDING, BUT NOT LIMITED TO, THE NUMBER OF LEAD BASED PAINT INSPECTIONS PERFORMED BY SUCH AUTHORITY, THE RESULTS OF SUCH INSPECTIONS, THE NUMBER OF INSPECTORS SUCH AUTHORITY HAS AND ANY OTHER INFORMATION THE CHAIR AND CHIEF EXECUTIVE OFFICER OF SUCH AUTHORITY DEEMS PERTINENT. 2. THE NEW YORK CITY HOUSING AUTHORITY SHALL AT LEAST ONCE EVERY TWO AND A HALF YEARS HAVE EVERY APARTMENT UNDER CONTROL OF SUCH AUTHORITY REPAINTED. SUCH AUTHORITY SHALL HIRE ITS TENANTS TO REPAINT THE APART- MENTS. § 2. The sum of one million dollars ($1,000,000), or so much thereof as may be necessary, is hereby appropriated to the New York city housing authority out of any moneys in the state treasury in the general fund to the credit of the state purposes account not otherwise appropriated for such authority to hire additional lead based paint inspectors. Such moneys shall be payable on the audit and warrant of the comptroller on vouchers certified or approved by the New York city housing authority in the manner prescribed by law. § 3.
