BILL NUMBER: S7802 SPONSOR: GALLIVAN TITLE OF BILL: An act to amend the highway law, in relation to increasing consolidated local highway assistance payments PURPOSE: To increase the payments associated with the consolidated local highway assistance program. SUMMARY OF SPECIFIC PROVISIONS: Section 1: c) except as provided in subparagraph (ii) of this paragraph, the moneys appropriated or authorized in each fiscal year pursuant to the schedule in paragraphs (a) and (b) of this subdivision shall be distributed in accordance with the procedures contained in subdivisions three and four of this section. The total of funds except as further provided in this paragraph, total funds distributed in accordance with the procedures contained in subdivision three of this section shall equal: one hundred forty-five million dollars in each fiscal year. GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the highway law, in relation to increasing consolidated local highway assistance payments THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (c) of subdivision 8 of section 10-c of the high- way law, as added by chapter 56 of the laws of 1993, is amended to read as follows: (c) [The] EXCEPT AS PROVIDED IN SUBPARAGRAPH (II) OF THIS PARAGRAPH, THE moneys appropriated or authorized in each fiscal year pursuant to the schedules in paragraphs (a) and (b) of this subdivision shall be distributed in accordance with the procedures contained in subdivisions three and four of this section. [The total of funds] (I) EXCEPT AS FURTHER PROVIDED IN THIS PARAGRAPH, TOTAL FUNDS distrib- uted in accordance with the procedures in subdivision three of this section shall equal one hundred forty-five million dollars in each fiscal year. The balance of funds shall be distributed in accordance with the procedures in subdivision four of this section. (II) FOR FISCAL YEARS TWO THOUSAND EIGHTEEN THROUGH TWO THOUSAND TWEN- TY-SEVEN THE TOTAL OF FUNDS DISTRIBUTED IN ACCORDANCE WITH THE PROCE- DURES IN SUBDIVISION THREE OF THIS SECTION SHALL EQUAL SIX HUNDRED FORTY-FIVE MILLION DOLLARS IN EACH SUCH FISCAL YEAR. OF SUCH TOTAL AMOUNT, FIVE HUNDRED MILLION DOLLARS SHALL BE DISTRIBUTED ONLY TO CITIES, COUNTIES, TOWNS AND VILLAGES OUTSIDE OF THE CITY OF NEW YORK IN ACCORDANCE WITH THE APPLICABLE PROVISIONS OF SUBDIVISION THREE OF THIS SECTION. For purposes of calculating distributions in accordance with subdivi- sion three of this section, the "funding level" shall be proportioned between amounts distributed pursuant to paragraphs (a) and (b) of this subdivision. § 2.
