BILL NUMBER: S8137 SPONSOR: RITCHIE TITLE OF BILL: An act to amend the county law, in relation to organ donation PURPOSE: TO ensure coroners and medical examiners throughout the state adhere to protocols that would enhance opportunities for donation. SUMMARY OF PROVISIONS: Section 1. Amends the county law and adds paragraph (c) which would direct coroners and medical examiners, in conjunction with their feder- ally designated organ procurement organization, to develop protocols when making referrals of deaths that fall under their jurisdiction and occur outside of a hospital. These protocols must include the coroner or medical examiner to call the federally designated organ procurement organization for donor registry verification and donor suitability determination.

RITCHIE, GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the county law, in relation to organ donation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 1 of section 671 of the county law, as amended by chapter 491 of the laws of 1987, is amended and a new paragraph (c) is added to read as follows: (b) shall make inquiry into all deaths whether natural or unnatural in his county occurring to an inmate of a correctional facility as defined by subdivision three of section forty of the correction law, whether or not the death occurred inside such facility[.]; (C) SHALL, IN CONJUNCTION WITH THEIR FEDERALLY DESIGNATED ORGAN PROCUREMENT ORGANIZATION, DEVELOP PROTOCOLS FOR MAKING REFERRALS OF DEATHS THAT FALL UNDER THEIR JURISDICTION AND OCCUR OUTSIDE OF A HOSPI- TAL. THESE PROTOCOLS SHALL INCLUDE, BUT SHALL NOT BE LIMITED TO, REQUIR- ING A CALL BE MADE TO THE FEDERALLY DESIGNATED ORGAN PROCUREMENT ORGAN- IZATION FOR DONOR REGISTRY VERIFICATION AND A DONOR SUITABILITY DETERMINATION. § 2.
