TITLE OF BILL:

An act to amend the transportation law, in relation to the intentional
removal of identification markers from commercial motor vehicles in the
city of New York

 
PURPOSE:

This bill provides a penalty for commercial vehicles that may inten-
tionally remove identification makers, such as registration stickers,
license plates, and VIN numbers in order to attempt to evade ticketing
for underlying offenses, such as illegal parking.

 
SUMMARY OF PROVISIONS:

This legislation-which applies only to commercial vehicles in New York
City-amends the Transportation Law to prohibit the removal of identifi-
cation makers, such as registration stickers, license plates, and VIN

numbers in order to attempt to evade ticketing for underlying offenses,
such as illegal parking.

A violation of this new prohibition would carry a fine of $2,00-$1000.

 
JUSTIFICATION:

The current penalties concerning the illegal parking of commercial vehi-
cles in New York City are not a sufficient deterrent to cease the prac-
tice. In certain areas of Queens, tractor-trailers line up on whole
streets for days on end causing issues with respect to public safety,
quality of life and the ability of residents to find parking for their
own automobiles. Furthermore, attempts to evade enforcement are preva-
lent with many truck drivers removing all identifying information-such
as registration stickers, license plates, and VIN numbers from their
vehicles so that tickets and towing on original violations cannot
proceed. This legislation will punish the act of evasion and hopefully
return the streets within our neighborhoods and communities to normalcy.

 AN ACT to amend the transportation law, in relation to  the  intentional
   removal  of  identification  markers from commercial motor vehicles in
   the city of New York
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph c of subdivision 2 of section 140 of the trans-
 portation law is amended by adding a new subparagraph (viii) to read  as
 follows:
   (VIII)(A)  IN  A  CITY  WITH  A  POPULATION OF ONE MILLION OR MORE, NO
 PERSON, CORPORATION, LIMITED LIABILITY COMPANY OR BUSINESS ENTITY, JOINT
 STOCK ASSOCIATION, PARTNERSHIP, OR ANY OFFICER OR AGENT  THEREOF,  SHALL
 KNOWINGLY  REMOVE OR ALLOW, PERMIT OR AUTHORIZE THE REMOVAL OF IDENTIFI-
 CATION FROM COMMERCIAL MOTOR VEHICLES THAT TRANSPORT PROPERTY IN  INTRA-
 STATE,  INTERSTATE OR INTERNATIONAL COMMERCE, FOR THE PURPOSE OF EVADING
 A TRAFFIC INFRACTION. SUCH IDENTIFICATION  SHALL  INCLUDE,  BUT  NOT  BE
 LIMITED TO, VEHICLE REGISTRATION PURSUANT TO SECTION FOUR HUNDRED ONE OF
 THE  VEHICLE  AND  TRAFFIC  LAW,  NUMBER PLATES PURSUANT TO SECTION FOUR
 HUNDRED TWO OF THE VEHICLE AND TRAFFIC LAW, AND  VEHICLE  IDENTIFICATION
 PURSUANT TO SECTION ONE HUNDRED FORTY-THREE OF THIS CHAPTER.
   (B)  A VIOLATION OF THIS SUBPARAGRAPH SHALL BE PUNISHABLE BY A FINE OF
 NOT LESS THAN TWO HUNDRED DOLLARS NOR MORE THAN ONE THOUSAND DOLLARS.
   § 2. This act shall take effect immediately.
