TITLE OF BILL:  An act to require the department of transportation to
determine which entrances to parkways in the state are most frequently
accessed by oversized commercial vehicles and to install certain barri-
ers to prevent such vehicles from accessing such entrances

 
PURPOSE OR GENERAL IDEA OF BILL:

This bill will direct the department of transportation (DOT) to study
which parkways frequently have accidents due to commercial vehicles
entering and authorize DOT to install physical barriers based on its
findings.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1. 1. Authorize the DOT to study which parkways have accidents
relating to oversized commercial vehicles and install physical barriers
to entry.

2. Allows the commissioner to work with other departments and agencies
to collect data.

3. Defines commercial motor vehicle for the purposes of this section.

Section 2. Effective Date.

 
JUSTIFICATION:

Parkways do not allow oversized vehicles for good reason - typically,
the bridges on parkways are not accommodating for the large height of
the vehicle. When an oversized vehicle enters a parkway despite the many
signs in place warning of the danger, the oversized vehicle often gets
involved in a crash with the low hanging bridge. It is clear these warn-
ing signs are not enough to deter oversized vehicle drivers. These acci-
dents cause damage not only to the vehicle itself but can even damage
our bridges and parkways, cause immense delays in commuters time, and
avoidable use of emergency services. Furthermore, these accidents can
result in physical injury or even loss of life to drivers and passen-
gers.

This legislation will allow the DOT to study where these accidents are
happening and the DOT to act on these findings. These swinging warning
barriers at the entrance ramps to the parkways, authorized by this
legislation, would properly notify truck drivers that their vehicles are
too tall to safely traverse certain state parkways. By installing barri-
ers to entry before oversized commercial vehicles enter the parkway, we
can prevent these vehicle accidents.

 AN ACT to require the department of transportation  to  determine  which
   entrances  to  parkways  in  the state are most frequently accessed by
   oversized commercial vehicles  and  to  install  certain  barriers  to
   prevent such vehicles from accessing such entrances

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The New York state department of transportation  is  hereby
 authorized and directed, within one hundred twenty days of the enactment
 of  this  act, to study and determine which entrances to parkways in the
 state are most frequently accessed by  commercial  motor  vehicles  and,
 within one year of making such determination, to install physical barri-
 ers  to  prevent or otherwise hinder such commercial motor vehicles from
 accessing such parkway entrances.
   2. The commissioner of transportation may request, and  is  authorized
 to  receive, from any department, division, board, bureau, commission or
 other agency of the state or any state public authority such information
 and data as will enable the department  of  transportation  to  properly
 conduct  its study and make its determination. Such information and data
 received by the department of transportation shall  be  subject  to  the
 same requirements for confidentiality and limitations on use, if any, as
 are  applicable  to  the use of such information and data by the depart-
 ment, division, board, bureau, commission or other agency of  the  state
 or state public authority which provided such information and data.
   3.  For the purposes of this act "commercial motor vehicle" shall have
 the same meaning as such term is defined in  subdivision  4  of  section
 501-a of the vehicle and traffic law, provided that such vehicle is also
 of  a  height  that  exceeds  the  clearance  of bridges located on such
 special parkways.
   § 2. This act shall take effect immediately.

Section 1 of the bill authorizes and directs the department of transpor-
tation to study and determine which entrances to parkways are used most
frequently by commercial motor vehicles and to install physical barriers
to prevent these vehicles from accessing such parkway entrances.

This section also authorizes the commissioner to receive from other
departments and agencies information and data to enable the department
to conduct its study and make its determination. It also defines commer-
cial motor vehicle for purposes of this act.

Section 2 is the effective date.

 
JUSTIFICATION:

The dangers and damages caused by trucks entering parkways have plagued
the State for years. Even when this is no physical damage, a truck's
travel on parkways creates traffic chaos and a safety hazard to other
motorists on a road designed for passenger vehicles.

Parkways do not allow oversized vehicles for good reason - typically,
bridges on parkways cannot accommodate the height of these vehicles.
When an oversized vehicle enters a. parkway, it is often involved in a
crash with a low hanging bridge. These accidents cause damage not only
to the vehicle but can damage bridges, cause delays for commuters, and
use emergency services. Furthermore ,ò these accidents can result in
physical injury or even loss of life to drivers and passengers.

While the DOT has taken measures, including signage, to reduce the inci-
dence of commercial vehicles on parkways the problem still remains. The
installation of physical barriers proposed by this legislation would
effectively notify truck drivers that their vehicles are too tall to
travel safely on these state parkways and reduce accidents and hazards
to motorists.
