RITCHIE -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law and the administrative code of the city of New York, in relation to requiring restaurants that offer online delivery services to post their most recent sanitary inspection letter grade on their website THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 1352-d of the public health law is renumbered subdivision 3 and a new subdivision 2 is added to read as follows: 2. (A) EVERY FOOD SERVICE ESTABLISHMENT THAT PROVIDES FOOD DELIVERY SERVICES ON THEIR WEBSITE AND/OR PROVIDES FOOD DELIVERY SERVICES THROUGH AN INTERNET-BASED FOOD DELIVERY SERVICE WEBSITE, AND IS REQUIRED BY ANY GENERAL, SPECIAL OR LOCAL LAW TO POST ITS MOST CURRENT SANITARY INSPECTION LETTER GRADE FROM THE DEPARTMENT, SHALL CONSPICUOUSLY POST SUCH FOOD SERVICE ESTABLISHMENT'S MOST CURRENT SANITARY INSPECTION LETTER GRADE FROM THE DEPARTMENT ON ALL SUCH WEBSITES THAT PROVIDE FOOD DELIVERY SERVICES TO CONSUMERS. (B) AS USED IN THIS SECTION, "INTERNET-BASED FOOD DELIVERY SERVICE" SHALL MEAN ANY FOOD SERVICE ESTABLISHMENT OR ANY THIRD-PARTY WEBSITE THAT ACCEPTS FOOD ORDERS FOR DELIVERY FROM CUSTOMERS VIA THE INTERNET. § 2. "INTERNET-BASED FOOD DELIVERY SERVICE" SHALL MEAN ANY FOOD SERVICE ESTABLISHMENT OR ANY THIRD-PARTY WEBSITE THAT ACCEPTS FOOD ORDERS FOR DELIVERY FROM CUSTOMERS VIA THE INTERNET. B.
