BILL NUMBER: S8842 SPONSOR: LAVALLE TITLE OF BILL: An act to amend the education law, in relation to state appropriations for increases in tuition credit PURPOSE: The purpose of this bill is to increase state support for SUNY and CUNY through coverage of the TAP gap. SUMMARY OF PROVISIONS: Sections 1 through four requires the state to cover the cost of any increase in the tuition credit currently covered by SUNY and CUNY. Section five establishes an immediate effective date. JUSTIFICATION:

LAVALLE -- read twice and ordered printed, and when printed to be committed to the Committee on Higher Education AN ACT to amend the education law, in relation to state appropriations for increases in tuition credit THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph 4 of paragraph h of subdivision 2 of section 355 of the education law is amended by adding a new clause (vii) to read as follows: (VII) BEGINNING IN STATE FISCAL YEAR TWO THOUSAND NINETEEN--TWO THOU- SAND TWENTY AND THEREAFTER, THE STATE SHALL APPROPRIATE AND MAKE AVAIL- ABLE GENERAL FUND OPERATING SUPPORT TO COVER ANY INCREASE IN THE TUITION CREDIT PURSUANT TO SECTION SIX HUNDRED EIGHTY-NINE-A OF THIS TITLE ANNU- ALLY. § 2. Subparagraph 4 of paragraph h of subdivision 2 of section 355 of the education law is amended by adding a new closing paragraph to read as follows: BEGINNING IN STATE FISCAL YEAR TWO THOUSAND NINETEEN--TWO THOUSAND TWENTY AND THEREAFTER, THE STATE SHALL APPROPRIATE AND MAKE AVAILABLE GENERAL FUND OPERATING SUPPORT TO COVER ANY INCREASE IN THE TUITION CREDIT PURSUANT TO SECTION SIX HUNDRED EIGHTY-NINE-A OF THIS TITLE ANNU- ALLY. § 3. Paragraph (a) of subdivision 7 of section 6206 of the education law is amended by adding a new subparagraph (vi) to read as follows: (VI) BEGINNING IN STATE FISCAL YEAR TWO THOUSAND NINETEEN--TWO THOU- SAND TWENTY AND THEREAFTER, THE STATE SHALL APPROPRIATE AND MAKE AVAIL- ABLE GENERAL FUND OPERATING SUPPORT TO COVER ANY INCREASE IN THE TUITION CREDIT PURSUANT TO SECTION SIX HUNDRED EIGHTY-NINE-A OF THIS CHAPTER ANNUALLY. § 4. Paragraph (a) of subdivision 7 of section 6206 of the education law is amended by adding a new closing paragraph to read as follows: BEGINNING IN STATE FISCAL YEAR TWO THOUSAND NINETEEN--TWO THOUSAND TWENTY AND THEREAFTER, THE STATE SHALL APPROPRIATE AND MAKE AVAILABLE GENERAL FUND OPERATING SUPPORT TO COVER ANY INCREASE IN THE TUITION EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets
