BILL NUMBER: S6250 TITLE OF BILL : An act to amend the executive law, in relation to requiring fire extinguishers in every rented dwelling PURPOSE OR GENERAL IDEA OF BILL : In the interest of public safety and fire prevention, this legislation provides clear standards in law requiring landlords to provide fire extinguishers in all rented apartments. SUMMARY OF PROVISIONS : Subdivision 5-e would be added to Section 378 of the Executive Law requiring the installation of fire extinguishers in all living units within a multiple dwelling. JUSTIFICATION : A recent devastating and tragic fire in Queens Village, which claimed the lives of five individuals-all under the age of 21-is a call to action in terms of fire safety. Sadly, the multiple dwelling that the victims lived in was found to be absent of any working smoke detectors and fire extinguishers. COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Housing, Construction and Community Development AN ACT to amend the executive law, in relation to requiring fire extin- guishers in every rented dwelling THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 378 of the executive law is amended by adding a new subdivision 5-e to read as follows: 5-E. STANDARDS FOR INSTALLATION OF FIRE EXTINGUISHERS REQUIRING THAT EVERY LIVING UNIT NOT OCCUPIED BY THE OWNER OF SUCH LIVING UNIT, WHICH SHALL INCLUDE BUT NOT BE LIMITED TO, A TWO-FAMILY DWELLING, OR ANY DWELLING ACCOMMODATION LOCATED IN A BUILDING OWNED AS A CONDOMINIUM OR COOPERATIVE IN THE STATE OR ANY MULTIPLE DWELLINGS SHALL HAVE INSTALLED AN OPERABLE FIRE EXTINGUISHER OF SUCH MANUFACTURE, DESIGN AND INSTALLA- TION STANDARDS AS ARE ESTABLISHED BY THE COUNCIL. FOR PURPOSES OF THIS SUBDIVISION, MULTIPLE DWELLING MEANS A DWELLING WHICH IS EITHER RENTED OR LEASED TO BE OCCUPIED, OR IS OCCUPIED AS THE TEMPORARY OR PERMANENT RESIDENCE OR HOME OF THREE OR MORE FAMILIES LIVING INDEPENDENTLY OF EACH OTHER, INCLUDING BUT NOT LIMITED TO THE FOLLOWING: A TENEMENT, FLAT HOUSE, MAISONETTE APARTMENT, APARTMENT HOUSE, APARTMENT HOTEL, TOURIST HOUSE, BACHELOR APARTMENT, STUDIO APARTMENT, DUPLEX APARTMENT, KITCHEN- ETTE APARTMENT, HOTEL, LODGING HOUSE, ROOMING HOUSE, BOARDING HOUSE, BOARDING AND NURSERY SCHOOL, FURNISHED ROOM HOUSE, CLUB, SORORITY HOUSE, FRATERNITY HOUSE, COLLEGE AND SCHOOL DORMITORY, CONVALESCENT, OLD AGE OR NURSING HOMES OR RESIDENCES. § 2.
