BILL NUMBER: S6921 SPONSOR: STAVISKY TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the displaying of a bus driver's credentials while he or she is on duty and the review of his or her files PURPOSE OR GENERAL IDEA OF BILL: To require the Department of Motor Vehicles to issue a new credential for individuals qualified to drive a bus under Article 19A of the Vehi- cle and Traffic Law and to require the display of such credential inside of a bus while the bus driver is on duty. This would allow consumers and passengers to verify that their bus driver has met all of the legal requirements to drive the bus. To require the Department of Motor Vehicles to perform an annual audit of motor carriers subject to VTL Article 19A requirements at least once a year to ensure that motor carriers are in compliance with the law. STAVISKY -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the vehicle and traffic law, in relation to the display- ing of a bus driver's credentials while he or she is on duty and the review of his or her files THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 3 and 4 of section 509-b of the vehicle and traffic law, as added by chapter 675 of the laws of 1985, are amended and a new subdivision 5 is added to read as follows: (3) has passed the bus driver physical examination administered pursu- ant to regulations established by the commissioner; [and] (4) is not disqualified to drive a motor vehicle pursuant to section five hundred nine-c or any other provision of this article[.]; AND (5) DISPLAYS PROMINENTLY, IN THE FRONT OF THE BUS, THE CREDENTIALS ISSUED BY THE DEPARTMENT AS REQUIRED IN SUBDIVISION EIGHT OF SECTION FIVE HUNDRED NINE-M OF THIS ARTICLE AS PROOF OF HIS OR HER QUALIFICA- TIONS WHILE HE OR SHE IS ON DUTY. § 2. Subdivision 1 of section 509-m of the vehicle and traffic law, as added by chapter 675 of the laws of 1985, is amended and a new subdivi- sion 8 is added to read as follows: 1. At least once [every three years] ANNUALLY, review the bus driver files of each motor carrier, provided, however, that the commissioner may review such bus driver files at his discretion at any other time during regular business hours. 8. ISSUE NEW CREDENTIALS, DESIGNED FOR PUBLIC DISPLAY, WHICH SHALL SERVE AS PROOF THAT A BUS DRIVER IS QUALIFIED UNDER SECTION FIVE HUNDRED NINE-B OF THIS ARTICLE. SUCH CREDENTIALS SHALL BE RE-ISSUED ANNUALLY. § 3. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
