S T A T E O F N E W Y O R K ________________________________________________________________________ 10603 I N A S S E M B L Y June 5, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Fall) -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to establishing the crimes of travel to riot in the first degree and travel to riot in the second degree THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 240.11 to read as follows: § 240.11 TRAVEL TO RIOT IN THE SECOND DEGREE. A PERSON IS GUILTY OF TRAVEL TO RIOT IN THE SECOND DEGREE WHEN HE OR SHE: 1. (A) COMMITS THE CRIME OF RIOT IN THE SECOND DEGREE AS DEFINED IN SECTION 240.05 OF THIS ARTICLE; OR (B) COMMITS THE CRIME OF INCITING TO RIOT AS DEFINED IN SECTION 240.08 OF THIS ARTICLE; AND 2. DOES NOT RESIDE IN NEW YORK STATE. TRAVEL TO RIOT IN THE SECOND DEGREE IS A CLASS E FELONY, AND PUNISHA- BLE BY A FINE OF UP TO ONE THOUSAND DOLLARS FOR A FIRST OFFENSE, A FINE OF UP TO THREE THOUSAND DOLLARS FOR A SECOND OFFENSE, AND A FINE OF UP TO FIVE THOUSAND DOLLARS FOR A THIRD OFFENSE AND ANY SUBSEQUENT OFFENSES COMMITTED THEREAFTER. § 2. The penal law is amended by adding a new section 240.12 to read as follows: § 240.12 TRAVEL TO RIOT IN THE FIRST DEGREE. A PERSON IS GUILTY OF TRAVEL TO RIOT IN THE FIRST DEGREE WHEN HE OR SHE: 1. COMMITS THE CRIME OF RIOT IN THE FIRST DEGREE AS DEFINED IN SECTION 240.06 OF THIS ARTICLE; AND 2. DOES NOT RESIDE IN NEW YORK STATE. Fall, Cusick, Darling) -- read once and referred to the Committee on Codes -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the penal law, in relation to imposing increased fines on certain individuals who commit riot in the first degree during a state disaster emergency THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 80.00 of the penal law is amended by adding a new subdivision 8 to read as follows: 8. WHEN A DEFENDANT IS TO BE SENTENCED FOR RIOT IN THE FIRST DEGREE AS DEFINED IN SUBDIVISION ONE OF SECTION 240.06 OF THIS CHAPTER, OCCURRING DURING A STATE DISASTER EMERGENCY DECLARED PURSUANT TO ARTICLE TWO-A OF THE EXECUTIVE LAW, AND WHERE SUCH DEFENDANT HAS PREVIOUSLY BEEN CONVICTED OF RIOT IN THE FIRST DEGREE AS DEFINED IN SUBDIVISION ONE OF SECTION 240.06 OF THIS CHAPTER TWO OR MORE TIMES, THE AMOUNT OF THE FINE SPECIFIED IN PARAGRAPH (A) OF SUBDIVISION ONE OF THIS SECTION MAY BE INCREASED BY UP TO AN ADDITIONAL TWO THOUSAND DOLLARS. § 2.
