S T A T E O F N E W Y O R K ________________________________________________________________________ 10635 I N A S S E M B L Y June 10, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Sayegh) -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to aiding in the transition to adulthood for children with medical fragility living in pediatric nursing homes and other settings THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public health law is amended by adding a new section 2808-e to read as follows: § 2808-E. RESIDENTIAL HEALTH CARE FOR CHILDREN WITH MEDICAL FRAGILITY IN TRANSITION TO YOUNG ADULTS AND YOUNG ADULTS WITH MEDICAL FRAGILITY. 1. FOR PURPOSES OF THIS SECTION: (A) "CHILDREN WITH MEDICAL FRAGILITY" SHALL MEAN CHILDREN UP TO TWEN- TY-ONE YEARS OF AGE WHO HAVE A CHRONIC DEBILITATING CONDITION OR CONDI- TIONS, ARE AT RISK OF HOSPITALIZATION, ARE TECHNOLOGY-DEPENDENT FOR LIFE OR HEALTH SUSTAINING FUNCTIONS, REQUIRE COMPLEX MEDICATION REGIMENS OR MEDICAL INTERVENTIONS TO MAINTAIN OR TO IMPROVE THEIR HEALTH STATUS, AND/OR ARE IN NEED OF ONGOING ASSESSMENT OR INTERVENTION TO PREVENT SERIOUS DETERIORATION OF THEIR HEALTH STATUS OR MEDICAL COMPLICATIONS THAT PLACE THEIR LIFE, HEALTH OR DEVELOPMENT AT RISK. (B) "YOUNG ADULTS WITH MEDICAL FRAGILITY" SHALL MEAN INDIVIDUALS WHO MEET THE DEFINITION OF CHILDREN WITH MEDICAL FRAGILITY, BUT FOR THE FACT SUCH INDIVIDUALS ARE AGED TWENTY-ONE YEARS OR OLDER. (C) "PEDIATRIC RESIDENTIAL HEALTH CARE FACILITY" SHALL MEAN A FREE- STANDING FACILITY OR DISCRETE UNIT WITHIN A FACILITY AUTHORIZED BY THE COMMISSIONER TO PROVIDE EXTENSIVE NURSING, MEDICAL, PSYCHOLOGICAL AND COUNSELING SUPPORT SERVICES SOLELY TO CHILDREN. 2. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, ANY CHILD WITH MEDICAL FRAGILITY WHO HAS RESIDED FOR AT LEAST THIRTY CONSEC- UTIVE DAYS IN A PEDIATRIC RESIDENTIAL HEALTH CARE FACILITY AND WHO HAS REACHED THE AGE OF TWENTY-ONE WHILE A RESIDENT, MAY CONTINUE RESIDING AT SUCH PEDIATRIC FACILITY AND RECEIVING SUCH SERVICES FROM THE FACILITY, PROVIDED THAT SUCH YOUNG ADULT WITH MEDICAL FRAGILITY REMAINS ELIGIBLE FOR NURSING HOME CARE.
