S T A T E O F N E W Y O R K ________________________________________________________________________ 1481 2019-2020 Regular Sessions I N A S S E M B L Y January 15, 2019 ___________ Introduced by M. of A. BICHOTTE -- read once and referred to the Commit- tee on Corporations, Authorities and Commissions AN ACT to amend the public authorities law and the economic development law, in relation to requiring public corporations and agencies to provide notice to each minority- or women-owned business enterprise that unsuccessfully bid on a contract of the reason or reasons why the business enterprise was unsuccessful in obtaining the contract THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Clause IV of subparagraph (H) of paragraph (j) of subdivi- sion 3 of section 2879 of the public authorities law, as added by chap- ter 174 of the laws of 2010, is amended and a new subparagraph (I) is added to read as follows: IV. consult the most recent disparity study pursuant to article fifteen-A of the executive law[.]; AND (I) A REQUIREMENT THAT, WITHIN THIRTY DAYS OF THE AWARDING OF A CONTRACT, THE CORPORATION AWARDING THE CONTRACT PROVIDE NOTICE TO EACH MINORITY- OR WOMEN-OWNED BUSINESS ENTERPRISE THAT UNSUCCESSFULLY BID ON THE CONTRACT OF THE REASON OR REASONS WHY THE BUSINESS ENTERPRISE WAS UNSUCCESSFUL IN OBTAINING THE CONTRACT. § 2. Section 143 of the economic development law is amended by adding a new subdivision 5 to read as follows: 5. WITHIN THIRTY DAYS OF THE AWARDING OF A CONTRACT, THE AGENCY AWARD- ING THE CONTRACT SHALL PROVIDE NOTICE TO EACH MINORITY- OR WOMEN-OWNED BUSINESS ENTERPRISE THAT UNSUCCESSFULLY BID ON THE CONTRACT OF THE REASON OR REASONS WHY THE BUSINESS ENTERPRISE WAS UNSUCCESSFUL IN OBTAINING THE CONTRACT. § 3. This act shall take effect on the ninetieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD00305-02-9
