 AN  ACT  to  amend  the  environmental  conservation law, in relation to
   authorizing local governments to require property  owners  to  replace
   trees which are removed

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1.  The environmental conservation law is amended by adding  a
 new section 9-1505 to read as follows:
 § 9-1505. REPLACEMENT OF TREES.
   ANY  LOCAL GOVERNMENT IS AUTHORIZED AND EMPOWERED TO ADOPT A LOCAL LAW
 OR ORDINANCE REQUIRING A PROPERTY OWNER TO PLANT TREES IN REPLACEMENT OF
 TREES REMOVED FROM THE PROPERTY OWNER'S  PROPERTY.  SUCH  LOCAL  LAW  OR
 ORDINANCE  MAY REQUIRE THE PROPERTY OWNER TO PLANT UP TO THREE TREES FOR
 EACH TREE REMOVED AND MAY INCLUDE PROPERTY TAX  CREDITS  AND  REASONABLE
 FINES AS DETERMINED BY THE MUNICIPALITY.
   § 2. This act shall take effect immediately.
