D'URSO -- read once and referred to the Committee on Environmental Conservation AN ACT to direct the department of environmental conservation to renew permits for access and use of certain wells in a county having a popu- lation of two million or more and wholly encompassed by a city, for periods of not more than 2 years THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any provision of law to the contrary, in any county having a population of two million or more and wholly encom- passed by a city, the department of environmental conservation shall only be authorized to renew, for a period of not more than two years, any permit which expires within one year of the effective date of this act and grants access and use by a city having a population of one million or more to any well or wells in such county which access a sole source aquifer. Provided, however, that any permit renewed pursuant to the provisions of this act shall authorize the agency, of the city having a population of one million or more, having responsibility for the supervision of the permitted wells, to conduct regular maintenance of such wells, and shall not authorize such city or agency to pump water therefrom unless the city having a population of one million or more experiences a loss of necessary drinking water which constitutes an emergency, as determined jointly by the commissioners of health and environmental conservation. ยง 2.
