S T A T E O F N E W Y O R K ________________________________________________________________________ 1957 2019-2020 Regular Sessions I N A S S E M B L Y January 18, 2019 ___________ Introduced by M. of A. ORTIZ -- read once and referred to the Committee on Codes AN ACT to amend the penal law, in relation to unlawfully installing gas meters THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The penal law is amended by adding a new section 270.40 to read as follows: § 270.40 UNLAWFULLY INSTALLING GAS METERS. 1. AS USED IN THIS SECTION "GAS METERS" MEANS ALL GAS METERS THAT MEASURE USAGE OF ANY END USE CUSTOMER OF GAS SERVICES. 2. A PERSON IS GUILTY OF UNLAWFULLY INSTALLING GAS METERS WHEN HE OR SHE INSTALLS THE GAS METERS; IS THE OWNER OF THE PREMISES WHERE THE METERS ARE UNLAWFULLY INSTALLED; OR OTHERWISE KNOWS THE METERS ARE UNLAWFULLY INSTALLED. A GAS METER IS UNLAWFULLY INSTALLED WHEN IT IS INSTALLED BY ANY PERSON OTHER THAN A PERSON ACTING ON BEHALF OF A UTILI- TY CORPORATION SUBJECT TO THE JURISDICTION OF THE PUBLIC SERVICE COMMIS- SION, UNLESS SUCH PERSON HAS RECEIVED A PERMIT TO INSTALL THE GAS METER FROM THE APPROPRIATE PERMITTING AUTHORITY. UNLAWFULLY INSTALLING GAS METERS IS A CLASS B MISDEMEANOR. § 2. This act shall take effect immediately.
