S T A T E O F N E W Y O R K ________________________________________________________________________ 2097 2019-2020 Regular Sessions I N A S S E M B L Y January 22, 2019 ___________ Introduced by M. of A. PERRY -- read once and referred to the Committee on Cities AN ACT to amend the administrative code of the city of New York, in relation to requiring a quality of life hearing and preparation of environmental impact statements prior to implementing traffic modifi- cations on streets with residential zoning in a city having a popu- lation of more than one million people THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The administrative code of the city of New York is amended by adding a new section 19-158.1 to read as follows: § 19-158.1 TRAFFIC MODIFICATIONS IMPACT STATEMENTS. NOTWITHSTANDING ANY LAW, RULE OR REGULATION TO THE CONTRARY, IN A CITY HAVING A POPU- LATION OF MORE THAN ONE MILLION PEOPLE, NO TRAFFIC MODIFICATIONS SHALL BE MADE ON STREETS WITH RESIDENTIAL ZONING UNTIL THE BOROUGH BOARD AND THE COMMUNITY BOARD OF THE AREA IN WHICH THE MODIFICATION IS TO BE MADE JOINTLY CONDUCT A "QUALITY OF LIFE" HEARING AND DETERMINE THAT THE QUAL- ITY OF LIFE IN THE AREA WILL NOT BE NEGATIVELY IMPACTED BY THE TRAFFIC MODIFICATIONS. THE BOROUGH AND COMMUNITY BOARDS SHALL JOINTLY PREPARE AN ENVIRONMENTAL IMPACT STATEMENT (EIS) REFLECTING THEIR FINDINGS. A SECOND ENVIRONMENTAL IMPACT STATEMENT (EIS) SHALL BE PREPARED BY THE MUNICI- PALITY. ALL ENVIRONMENTAL IMPACT STATEMENTS SHALL BE FUNDED BY THE MUNI- CIPALITY. § 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law.
