LENTOL -- read once and referred to the Committee on Environmental Conservation AN ACT to amend the environmental conservation law, in relation to comprehensive accident prevention planning by and auditing of petrole- um bulk storage facilities in cities with a population of one million or more THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The environmental conservation law is amended by adding a new section 17-1006 to read as follows: § 17-1006. COMPREHENSIVE ACCIDENT PREVENTION IN CITIES WITH A POPULATION OF ONE MILLION OR MORE. EVERY OWNER OR OPERATOR OF A FACILITY, AS DEFINED IN SUBDIVISION ONE OF SECTION 17-1003 OF THIS TITLE, LOCATED WITHIN A CITY WITH A POPU- LATION OF ONE MILLION OR MORE SHALL UNDERTAKE COMPREHENSIVE ACCIDENT PREVENTION PLANNING FOR THE PREVENTION OF SPILLS AND LEAKS OF PETROLEUM, AND SHALL HIRE AN INDEPENDENT COMPANY TO AUDIT, ON A QUARTERLY BASIS, THE IMPLEMENTATION BY SUCH OWNER OR OPERATOR OF THE HAZARD CONTROL PLAN ADOPTED FOR SUCH FACILITY. § 2. This act shall take effect on the one hundred twentieth day after it shall have become a law; provided, however effective immediately the commissioner of environmental conservation may promulgate rules and regulations necessary to effectuate the provisions of this act prior to such effective date.
