COLTON, RIVERA, ABBATE -- Multi-Sponsored by -- M. of A. COOK -- read once and referred to the Committee on Transpor- tation AN ACT to amend the vehicle and traffic law, in relation to parking infractions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (b) of subdivision 2-a of section 238 of the vehicle and traffic law, as added by chapter 224 of the laws of 1995, is amended to read as follows: (b) If any information which is required to be inserted on a notice of violation is omitted from the notice of violation, misdescribed, or illegible, the violation shall be dismissed upon application of the person charged with the violation. SUCH APPLICATION FOR DISMISSAL SHALL BE AVAILABLE TO THE PERSON CHARGED WITH THE VIOLATION DESPITE THE FACT THAT A DEFAULT JUDGMENT WAS ENTERED PURSUANT TO SECTION TWO HUNDRED FORTY-ONE OF THIS ARTICLE. § 2. This act shall take effect on the thirtieth day after it shall have become a law and shall apply to any notice of violation issued after such date.
