 AN ACT to amend the  not-for-profit  corporation  law,  in  relation  to
   activities prohibited to not-for-profit corporations
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The not-for-profit corporation law is amended by  adding  a
 new section 204-a to read as follows:
 § 204-A. RESTRICTED ACTIVITIES.
   (A) AS USED IN THIS SECTION, THE TERM "DRUG INJECTION SITE" SHALL MEAN
 ANY  PROGRAM  OR ENTITY THAT PROVIDES A HYGIENIC SPACE FOR AN INDIVIDUAL
 TO CONSUME A CONTROLLED SUBSTANCE IN VIOLATION OF  ARTICLE  THIRTY-THREE
 OF THE PUBLIC HEALTH LAW.
   (B)  NOTWITHSTANDING  ANY OTHER PROVISION OF THIS CHAPTER OR ANY OTHER
 GENERAL LAW, A CORPORATION OF ANY KIND TO  WHICH  THIS  CHAPTER  APPLIES
 SHALL NOT OPERATE A DRUG INJECTION SITE WITHIN THE STATE.
   §  2.  This  act shall take effect on the ninetieth day after it shall
 have become a law.
