BRAUNSTEIN, DINOWITZ -- (at request of the Office of Court Administration) -- read once and referred to the Committee on Judiciary AN ACT to amend the civil practice law and rules, in relation to commis- sions for receivers of rents and profits THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision (a) of section 8004 of the civil practice law and rules is amended to read as follows: (a) Generally. A receiver, except where otherwise prescribed by stat- ute, is entitled to such commissions[, not exceeding five per cent upon the sums received and disbursed by him,] as the court by which [he] THE RECEIVER is appointed allows[, but if in any case the commissions, so computed, do not amount to one hundred dollars, the court, may allow the receiver such a sum, not exceeding one hundred dollars, as shall be commensurate with the services he rendered]. § 2. This act shall take effect immediately and shall apply to all actions pending on or after such effective date.
