SEAWRIGHT -- read once and referred to the Committee on Environmental Conservation AN ACT to direct the department of environmental conservation to adopt rules and regulations requiring permittees to place air monitoring equipment near permitted waste transfer stations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. No later than January 1, 2021, the department of environ- mental conservation shall adopt rules and regulations requiring permit- tees to conduct continuous air monitoring to measure data for sulfur dioxide, oxides of nitrogen, carbon dioxide, meteorological data, PM 1.0 and PM 2.5. Such regulations shall also require that for each pollutant monitors utilized are designated as federal reference methods or federal equivalent methods, as applicable, in accordance with 40 CFR Part 53; are continuously-recording types, if available; and that the number and locations of monitors shall be adequate to detect pollution concen- tration gradients of emissions from operation of the facility that affect publicly accessible areas near the facility. Resulting air quality data shall be required to be made available to the department of environmental conservation and the public and posted on the department's website. ยง 2.
