Relates to providing records for protection and advocacy services in a timely manner of not longer than three business days upon written request and within twenty-four hours when there is probable cause to believe the health or safety of an individual is in serious or immediate jeopardy.

 AN ACT to amend the correction law, in relation to providing records for
   protection and advocacy services in a timely manner
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  The correction law is amended by adding a new section 626
 to read as follows:
   § 626. RECORDS FOR PROTECTION AND ADVOCACY SERVICES. 1.  UPON  RECEIPT
 OF A WRITTEN REQUEST FOR RECORDS FROM THE ORGANIZATION DESIGNATED BY THE
 GOVERNOR PURSUANT TO SUBDIVISION (B) OF SECTION FIVE HUNDRED FIFTY-EIGHT
 OF  THE  EXECUTIVE  LAW  TO PROVIDE PROTECTION AND ADVOCACY SERVICES AND
 ADMINISTER THE PROTECTION AND  ADVOCACY  SYSTEM,  THE  DEPARTMENT  SHALL
 FURNISH  ACCESS  TO AND PROVIDE COPIES OF SUCH RECORDS TO SUCH ORGANIZA-
 TION NOT LATER THAN THREE  BUSINESS  DAYS  AFTER  THE  RECEIPT  OF  SUCH
 REQUEST.  IF  SUCH ORGANIZATION STATES IN ITS WRITTEN REQUEST THAT THERE
 IS PROBABLE CAUSE TO BELIEVE THE HEALTH OR SAFETY OF AN INDIVIDUAL IS IN
 SERIOUS AND IMMEDIATE JEOPARDY OR IN THE CASE OF THE DEATH OF  AN  INDI-
 VIDUAL  WITH  A  DISABILITY,  THE DEPARTMENT SHALL FURNISH ACCESS TO AND
 PROVIDE COPIES OF SUCH RECORDS WITHIN TWENTY-FOUR HOURS OF  THE  RECEIPT
 OF SUCH WRITTEN REQUEST.
   2.  COPIES  OF RECORDS PROVIDED PURSUANT TO THIS SECTION SHALL BE FREE
 OF CHARGE.
   § 2. This act shall take effect immediately.
