Relates to subjecting owners who knew or should have known about an alteration in violation of the uniform code to a civil penalty; subjects owners to up to a seven thousand five hundred dollar penalty when the alteration to the building violated the uniform code and impeded a person's egress from the building during an evacuation.

DeSTEFANO -- read once and referred to the Committee on Governmental Operations AN ACT to amend the executive law, in relation to subjecting owners who knew or should have known about an alteration in violation of the uniform code to a civil penalty THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 382 of the executive law is amended by adding a new subdivision 4 to read as follows: 4. WHERE A BUILDING HAS BEEN ALTERED IN VIOLATION OF ANY PROVISION OF THE UNIFORM CODE OR ANY LAWFUL ORDER OBTAINED THEREUNDER, AND SUCH ALTERATION IMPEDES A PERSON'S EGRESS FROM SUCH BUILDING DURING A FIRE OR OTHER EMERGENCY EVACUATION, THE OWNER OF SUCH BUILDING WHO HAS KNOWLEDGE OF SUCH ALTERATION OR SHOULD HAVE HAD KNOWLEDGE OF SUCH ALTERATION SHALL BE SUBJECT TO A CIVIL PENALTY OF UP TO SEVEN THOUSAND FIVE HUNDRED DOLLARS. § 2.
