S T A T E O F N E W Y O R K ________________________________________________________________________ 875 2019-2020 Regular Sessions I N A S S E M B L Y January 11, 2019 ___________ Introduced by M. of A. QUART -- Multi-Sponsored by -- M. of A. LAVINE -- read once and referred to the Committee on Election Law AN ACT to amend the election law, in relation to annual reports of the boards of elections THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 4 of section 3-212 of the election law, as amended by chapter 90 of the laws of 1991, is amended and a new paragraph (c) is added to read as follows: (a) Each board of elections shall make an annual report of its affairs and proceedings to its local legislative body once every twelve months and no later than the last day of January in any year. A copy of said annual report shall be filed with the state board of elections AND SHALL BE MADE AVAILABLE TO THE PUBLIC ON THE WEBSITE MAINTAINED BY ANY BOARD OF ELECTIONS, INCLUDING THE STATE BOARD OF ELECTIONS, NO LATER THAN FIVE DAYS AFTER SAID REPORT IS DELIVERED TO THE STATE BOARD. (C) SAID ANNUAL REPORT, AS REQUIRED BY PARAGRAPH (A) OF THIS SUBDIVI- SION, SHALL INCLUDE THE FOLLOWING PERFORMANCE METRICS FOR THE PRECEDING CALENDAR YEAR: (1) THE NUMBER OF ELECTIONS ADMINISTERED IN THE PRECEDING CALENDAR YEAR, INCLUDING ALL PRIMARY, GENERAL AND SPECIAL ELECTIONS, LISTED BY DATE WITH THE OFFICES INCLUDED IN EACH ELECTION AND ANY REFERENDUM QUES- TIONS; (2) THE NUMBER OF BALLOTS DELIVERED TO EACH POLL SITE, THE NUMBER OF BALLOTS CAST BY SCANNING AT EACH POLL SITE SCANNER, AND THE NUMBER OF BALLOTS COUNTED AT EACH COUNTY BOARD OF ELECTIONS OFFICE, INCLUDING A SEPARATE LISTING FOR THE NUMBER OF EMERGENCY, ABSENTEE, MILITARY AND OVERSEAS BALLOTS COUNTED AT EACH COUNTY BOARD OF ELECTIONS OFFICE; (3) THE NUMBER OF ELECTION INSPECTORS AND POLL CLERKS EMPLOYED FOR EACH ELECTION, THE TOTAL NUMBER OF UNFILLED ELECTION INSPECTOR OR POLL EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
