BARRETT -- read once and referred to the Commit- tee on Veterans' Affairs AN ACT to amend the executive law, in relation to defining certain qual- ifying conditions for veterans THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 350 of the executive law, as added by chapter 490 of the laws of 2019, is amended to read as follows: 8. The term "qualifying condition" means a diagnosis of post-traumatic stress disorder or traumatic brain injury made by, or an experience of military sexual trauma, as described in 38 USC 1720D, as amended from time to time, disclosed to, an individual licensed to provide health care services at a United States Department of Veterans Affairs facility OR AN INDIVIDUAL LICENSED TO PROVIDE HEALTH CARE SERVICES WITHIN THE STATE OF NEW YORK. The division shall develop a standardized form used to confirm that the veteran has a qualifying condition under this subdi- vision. § 2. This act shall take effect on the same date and in the same manner as section 1 of chapter 490 of the laws of 2019, takes effect.
