 AN  ACT  to  amend  the  education law, in relation to requiring monthly
   inspections of all AED equipment
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 917 of the education law is amended by adding a new
 subdivision 5 to read as follows:
   5.  ALL  AED  EQUIPMENT SHALL BE INSPECTED AND TESTED AT INTERVALS NOT
 EXCEEDING ONE MONTH BY ANY STAFF WHO  HOLDS  A  VALID  CERTIFICATION  OF
 COMPLETION  OF  A  COURSE  IN  THE  STUDY  OF  THE  OPERATION  OF  AEDS.
 INSPECTIONS AND TESTS SHALL BE PERFORMED IN ACCORDANCE WITH THE APPLICA-
 BLE STANDARDS OF THE MANUFACTURER AND ANY APPROPRIATE GOVERNMENT AGENCY.
 ANY AED DEVICE THAT DOES NOT MEET SUCH  APPLICABLE  STANDARDS  SHALL  BE
 EXCHANGED  FOR  A  NEW AED DEVICE WITH THE COORDINATING EMERGENCY HEALTH
 CARE PROVIDER PURSUANT TO SECTION THREE THOUSAND-B OF THE PUBLIC  HEALTH
 LAW.   A WRITTEN RECORD OF ALL MAINTENANCE AND TESTING PERFORMED ON AEDS
 SHALL BE MAINTAINED  AND  SUBMITTED  ANNUALLY  TO  THE  COMMISSIONER  OF
 HEALTH.
   § 2. This act shall take effect immediately.
