S T A T E O F N E W Y O R K ________________________________________________________________________ 9662 I N A S S E M B L Y February 4, 2020 ___________ Introduced by M. of A. SAYEGH -- read once and referred to the Committee on Education AN ACT to amend the education law, in relation to requiring a yearly inspection of all audiological testing equipment THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The education law is amended by adding a new section 923 to read as follows: § 923. AUDIOLOGICAL TESTING EQUIPMENT INSPECTION. 1. ALL AUDIOLOGICAL TESTING EQUIPMENT SHALL BE INSPECTED AND TESTED AT INTERVALS NOT EXCEED- ING ONE YEAR. INSPECTIONS AND TESTS SHALL BE PERFORMED IN ACCORDANCE WITH THE APPLICABLE STANDARDS OF THE MANUFACTURER AND ANY APPROPRIATE GOVERNMENT AGENCY. ANY AUDIOLOGICAL TESTING EQUIPMENT THAT DOES NOT MEET SUCH APPLICABLE STANDARDS SHALL BE EXCHANGED FOR NEW AUDIOLOGICAL TEST- ING EQUIPMENT. 2. FOR THE PURPOSES OF THIS SECTION, "AUDIOLOGICAL TESTING EQUIPMENT" SHALL MEAN ANY EQUIPMENT OR DEVICE USED DURING A HEARING EXAMINATION PURSUANT TO SECTION NINE HUNDRED FIVE OF THIS ARTICLE. § 2. This act shall take effect on the thirtieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized to be made and completed on or before such effective date.
