 Introduced  by  Sen.  SERINO -- read twice and ordered printed, and when
   printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to donation of  blood
   by patients with a history of Lyme or tick-borne illnesses
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 3121 of the public health law is amended by  adding
 a new subdivision 6 to read as follows:
   6. (A) THE COUNCIL SHALL REVIEW ALL CURRENT MEDICAL RESEARCH AND GUID-
 ANCE  REGARDING THE DONATION OF BLOOD BY PATIENTS WITH A HISTORY OF LYME
 OR TICK-BORNE ILLNESSES, INCLUDING BUT NOT LIMITED TO:
   (I) HUMAN ANAPLASMOSIS;
   (II) BABESIOSIS;
   (III) HUMAN EHRLICHIOSIS;
   (IV) ROCKY MOUNTAIN SPOTTED FEVER;
   (V) POWASSAN VIRUS;
   (VI) SOUTHERN TICK-ASSOCIATED RASH ILLNESS; AND
   (VII) OTHER RELATED ILLNESSES AND CO-INFECTIONS.
   (B) (I) THE COUNCIL SHALL, WITHIN NINETY DAYS AFTER THE EFFECTIVE DATE
 OF THIS SUBDIVISION, ISSUE RECOMMENDATIONS TO THE COMMISSIONER REGARDING
 THE COLLECTION, TESTING, AND DISTRIBUTION OF BLOOD DONATIONS  WITH  LYME
 AND  TICK-BORNE  ILLNESSES  PRESENT  OR  REPORTED  IN A PATIENT HISTORY,
 INCLUDING BUT NOT LIMITED TO:
   (1) CONSIDERATIONS OF THE CURRENT STATE OF MEDICAL RESEARCH; AND
   (2) RECOMMENDATIONS FOR TEMPORARY  OR  PERMANENT  MORATORIUMS  ON  THE
 COLLECTION OF BLOOD WITH LYME AND TICK-BORNE RELATED ILLNESSES PRESENT.
   (II)  UPON  IMMEDIATE RECEIPT OF SUCH RECOMMENDATION, THE COMMISSIONER
 SHALL PROVIDE A COPY OF SUCH TO THE SPEAKER  OF  THE  ASSEMBLY  AND  THE
 TEMPORARY PRESIDENT OF THE SENATE.
   § 2. This act shall take effect immediately.
