BILL NUMBER: S1372 SPONSOR: RITCHIE TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the defi- nition of an all terrain vehicle or "ATV" PURPOSE: This bill raises the defined weight of an all terrain vehicle to 1,500 pounds of dry weight to allow certain all terrain vehicles to be regis- tered in New York. SUMMARY OF PROVISIONS: Section 1 amends the definition of an "all terrain vehicle" in chapter 319 of the Vehicle and Traffic Law by raising the dry weight qualifica- tion from 1,000 pounds to 1,500 pounds for certain all terrain vehicles. Section 2 provides the effective date.

RITCHIE, AKSHAR, GALLIVAN, GRIFFO, HELMING, O'MARA, ORTT, SEWARD, YOUNG -- read twice and ordered printed, and when print- ed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to the defi- nition of an all terrain vehicle or "ATV" THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 2281 of the vehi- cle and traffic law, as amended by chapter 319 of the laws of 1997, is amended to read as follows: (a) "All terrain vehicle" or "ATV" means any self-propelled vehicle which is manufactured for sale for operation primarily on off-highway trails or off-highway competitions and only incidentally operated on public highways providing that such vehicle does not exceed seventy inches in width, or one thousand FIVE HUNDRED pounds dry weight. Provided, however, this definition shall not include a "snowmobile" or other self-propelled vehicles manufactured for off-highway use exclu- sively designed for travel on snow or ice, steered by skis or runners and supported in whole or in part by one or more skis, belts or cleats which utilize an endless belt tread. § 2. This act shall take effect on the thirtieth day after it shall have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD03918-01-9
