BILL NUMBER: S1464 SPONSOR: SANDERS TITLE OF BILL: An act to amend the general business law, in relation to internet service provider privacy requirements PURPOSE: Any person, business or organization qualified to do business in this state that provides individuals, corporations, or other entities with the ability to connect to the internet through equipment that is located in this state. SANDERS -- read twice and ordered printed, and when printed to be committed to the Committee on Consumer Protection AN ACT to amend the general business law, in relation to internet service provider privacy requirements THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general business law is amended by adding a new section 390-d to read as follows: § 390-D. INTERNET SERVICE PROVIDER PRIVACY REQUIREMENTS. 1. AS USED IN THIS SECTION "INTERNET SERVICE PROVIDER" MEANS ANY PERSON, BUSINESS OR ORGANIZATION QUALIFIED TO DO BUSINESS IN THIS STATE THAT PROVIDES INDI- VIDUALS, CORPORATIONS, OR OTHER ENTITIES WITH THE ABILITY TO CONNECT TO THE INTERNET THROUGH EQUIPMENT THAT IS LOCATED IN THIS STATE. 2. ALL INTERNET SERVICE PROVIDERS OFFERING SERVICES TO NEW YORK STATE CUSTOMERS SHALL KEEP ALL CUSTOMER INFORMATION CONFIDENTIAL UNLESS WRIT- TEN CONSENT IS PROVIDED BY THE CUSTOMER. 3. AN INTERNET SERVICE PROVIDER FOUND TO BE IN VIOLATION OF THIS SECTION SHALL BE SUBJECT TO A FINE OF FIVE HUNDRED DOLLARS FOR EACH OFFENSE. § 2. This act shall take effect immediately.
