BILL NUMBER: S1706 SPONSOR: SEPULVEDA TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to requiring weather radios in motor vehicles sold within the state with a model year of 2022 or later PURPOSE OR GENERAL IDEA OF THE BILL: An act to amend the vehicle and traffic law, requiring weather radios to be mandatory in automobile sales across the state beginning with all 2022 models sold to enhance public safety as deadly severe weather is becoming the norm in New York State. SUMMARY OF SPECIFIC PROVISIONS: Section 1., Article 9 of the Vehicle and Traffic Law is amended by adding a new section 384 to read as follows: All new model vehicles sold beginning model year 2021 must have a weath- er radio installed as part of its audio system.

SEPULVEDA -- read twice and ordered printed, and when printed to be committed to the Committee on Transportation AN ACT to amend the vehicle and traffic law, in relation to requiring weather radios in motor vehicles sold within the state with a model year of 2022 or later THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 9 of the vehicle and traffic law is amended by adding a new section 384 to read as follows: § 384. WEATHER RADIO. 1. WEATHER RADIO REQUIRED. NO NEW MOTOR VEHICLE, EXCEPT A VEHICLE WITH A MODEL YEAR OF TWO THOUSAND TWENTY-ONE OR EARLI- ER, SHALL BE SOLD IN THIS STATE UNLESS SUCH VEHICLE IS EQUIPPED WITH A WEATHER RADIO, INSTALLED AS PART OF THE VEHICLE'S AUDIO SYSTEM, APPROVED BY AND CONFORMING TO STANDARDS ESTABLISHED BY THE COMMISSIONER. 2. WEATHER RADIO FEATURE. A WEATHER RADIO SHALL BE CAPABLE OF RECEIV- ING THE NATIONAL OCEANIC AND ATMOSPHERIC ADMINISTRATION'S DAILY WEATHER REPORTS AND EMERGENCY BROADCASTS. 3. COSTS OF WEATHER RADIOS. NO CAR DEALERSHIP SHALL INCREASE THE COST OF A VEHICLE DUE TO THE VEHICLE'S AUDIO SYSTEM CONTAINING A WEATHER RADIO. 4. REGULATIONS. THE COMMISSIONER SHALL ESTABLISH BY REGULATION STAND- ARDS FOR WEATHER RADIOS, AND THE INSTALLATION OF WEATHER RADIOS IN MOTOR VEHICLES. THE COMMISSIONER MAY PRESCRIBE THE METHOD OF SECURING APPROVAL OF WEATHER RADIOS. § 2. The commissioner of motor vehicles is authorized to promulgate any rules and regulations necessary for the implementation of section one of this act on or before the one hundred twentieth day after the effective date of this section. § 3. This act shall take effect immediately; provided, however, that section one of this act shall take effect January 1, 2021.
