BILL NUMBER: S1818 SPONSOR: RIVERA TITLE OF BILL: An act to amend the social services law, in relation to timely filing of Medicaid claims PURPOSE: To provide a mechanism to file and pay Medicaid claims when submission is delayed due to implementing a new or upgraded medical record system. SUMMARY OF PROVISIONS: Amend SSL § 367-b to require the department to establish a delay reason code for claims that are not submitted within the State's timely filing requirements due to complications caused by a new or upgraded medical record system.

RIVERA -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the social services law, in relation to timely filing of Medicaid claims THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 8 of section 367-b of the social services law is amended by adding a new paragraph (d) to read as follows: (D) THE COMMISSIONER SHALL PROVIDE BY REGULATION FOR A DELAY REASON CODE TO ALLOW THE FILING AND PAYING OF OTHERWISE-VALID MEDICAL ASSIST- ANCE CLAIMS THAT ARE NOT SUBMITTED IN ACCORDANCE WITH THE DEPARTMENT'S TIMELY FILING REQUIREMENTS DUE TO THE IMPLEMENTATION OF A NEW OR UPGRADED ELECTRONIC MEDICAL RECORD SYSTEM. § 2. This act shall take effect on the ninetieth day after it shall become a law. The commissioner of health shall make regulations and take other actions reasonably necessary to implement this act on its effec- tive date.
