BILL NUMBER: S2383 SPONSOR: COMRIE TITLE OF BILL: An act to amend the public service law, in relation to requiring certain information to be filed with the department of public service PURPOSE: The purpose of this bill is to ensure fuel gas transmission lines of all pressures are regulated, inspected, and mapped by the Public Service Commission (PSC). SUMMARY OF PROVISIONS: Section 1 amends the public service law to define the terms "gathering line" and "pipeline facility" and consequently require the filing of plans with the PSC by those who wish to construct such lines. Addi- tionally, the plans are required to contain spatial mapping data which will be used by the PSC and Department of Environmental Conversation

COMRIE -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to requiring certain information to be filed with the department of public service THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The public service law is amended by adding a new section 121-b to read as follows: § 121-B. FILING OF CERTAIN INFORMATION. 1. ALL PERSONS WHO INTEND TO CONSTRUCT A GAS GATHERING LINE OR A PIPELINE FACILITY, SHALL FILE WITH THE DEPARTMENT SPATIAL MAPPING DATA, INCLUDING BUT NOT LIMITED TO GEOGRAPHIC INFORMATION SYSTEM DATA, DETAILING THE LOCATION OF SUCH PROPOSED GATHERING LINE OR PIPELINE FACILITY. 2. THE DEPARTMENT, IN CONSULTATION WITH THE DEPARTMENT OF ENVIRON- MENTAL CONSERVATION, SHALL ESTABLISH AND MAINTAIN A COMPUTER MAPPING SYSTEM FOR PLOTTING THE LOCATION OF GATHERING LINES AND PIPELINE FACILI- TIES. SUCH MAPS SHALL OVERLAY LOCATIONS SUBJECT TO THE PROVISIONS OF ARTICLE TWENTY-THREE OF THE ENVIRONMENTAL CONSERVATION LAW. 3. FOR PURPOSES OF THIS SECTION, THE FOLLOWING TERMS SHALL HAVE THE FOLLOWING MEANINGS: (A) "GATHERING LINE" MEANS A PIPELINE THAT TRANSPORTS GAS FROM A CURRENT PRODUCTION FACILITY TO A TRANSMISSION LINE, MAIN, OR DIRECTLY TO AN END USER. (B) "PIPELINE FACILITY" MEANS NEW AND EXISTING PIPELINE, RIGHTS-OF- WAY, AND ANY RELATED EQUIPMENT, FACILITY, OR BUILDING, USED IN THE TRANSPORTATION OF GAS, OR IN THE TREATMENT OF GAS DURING THE COURSE OF TRANSPORTATION, IN CONNECTION WITH THE PRODUCTION, GATHERING, TREATMENT OR PROCESSING OF SUCH GAS, BUT DOES NOT INCLUDE ANY: (I) TRANSMISSION AND DISTRIBUTION SYSTEM OPERATED BY A LOCAL DISTRIBUTION COMPANY SUBJECT TO THE JURISDICTION OF THE COMMISSION FOR PURPOSES OF PROVIDING RETAIL EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
