TITLE OF BILL:

An act to amend the agriculture and markets law, in relation to the task
force on improving urban and rural consumer access to locally produced,
healthy foods; and providing for the repeal of such provisions upon
expiration thereof

 
PURPOSE:

This legislation creates the Task Force on Improving Urban and Rural
Consumer Access to Locally-Produced, Healthy Foods.

 
SUMMARY OF PROVISIONS:

Section 1. Amends Article 2, Section 16 of agriculture and markets law
to establish the Task Force on Improving Urban and Rural Consumer Access
to Locally-Produced, Healthy Foods. The Task Force is made up of eleven
members and will have the Commissioner of Agriculture and Markets as the

Chair. Four members of the Task Force will be appointed by the governor,
two members will be appointed by the temporary president of the senate,
two members will be appointed by the speaker of the assembly, one member
will be appointed by the minority leader of the senate, and one member
will be appointed by the minority leader of the assembly.

The appointed members of such Task Force will be farmers, represen-
tatives of non-for-profit food access organizations, the grocery indus-
try and economic development agencies serving county, New York State and
New York City governments.

The Task Force will identify strategies and opportunities to expand
access for underserved, nutritionally deficient urban and rural communi-
ties to healthy, locally produced food in New York State. The task force
shall develop and identify new and innovative methods to increase the
production, marketing and distribution of locally produced, fresh food
in such communities in New York State.  The Task Force shall report to
the governor arid the legislature on its activities, findings, and
recommendations.

Section 2. This act shall take effect immediately and shall expire and
be deemed repealed December 31, 2020.

 
EXISTING LAW:

There is no such Task Force under existing law.

 
JUSTIFICATION:

Farmers have long sought greater market access in New York City and
other urban areas of the state. Similarly, residents of urban areas
continually seek out access to low-cost, healthy and locally produced
food from New York's farmers. The match between the two has never been
effectively achieved through market forces or public policy initiatives.
This bill marries these two efforts to form a strategy among industry
and government leaders to identify opportunities and barriers to achieve
this much needed linkage between farmers and millions of potential
consumers of their products.

 AN ACT to amend the agriculture and markets law, in relation to the task
   force  on  improving  urban  and  rural  consumer  access  to  locally
   produced,  healthy  foods;  and  providing  for  the  repeal  of  such
   provisions upon expiration thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. The agriculture and markets law is amended by adding a new
 section 28 to read as follows:
   § 28. TASK FORCE ON IMPROVING  URBAN  AND  RURAL  CONSUMER  ACCESS  TO
 LOCALLY  PRODUCED,  HEALTHY  FOODS.  1. THERE IS HEREBY CREATED THE TASK
 FORCE ON IMPROVING URBAN AND RURAL CONSUMER ACCESS TO LOCALLY  PRODUCED,
 HEALTHY FOODS. THE TASK FORCE IS TO BE COMPRISED OF ELEVEN MEMBERS. SUCH
 TASK  FORCE  SHALL  HAVE  ONE  EX-OFFICIO  CHAIRPERSON, WHO SHALL BE THE
 COMMISSIONER OR HIS OR HER DESIGNEE. FOUR MEMBERS SHALL BE APPOINTED  BY
 THE  GOVERNOR, TWO MEMBERS SHALL BE APPOINTED BY THE TEMPORARY PRESIDENT
 OF THE SENATE, TWO MEMBERS SHALL BE APPOINTED  BY  THE  SPEAKER  OF  THE
 ASSEMBLY,  ONE  MEMBER  SHALL BE APPOINTED BY THE MINORITY LEADER OF THE
 SENATE AND ONE MEMBER SHALL BE APPOINTED BY THE MINORITY LEADER  OF  THE
 ASSEMBLY.  THE  APPOINTED  MEMBERS OF SUCH TASK FORCE SHALL BE REPRESEN-
 TATIVE OF:
   (A) A FARM ENGAGED IN GROWING CROPS, LIVESTOCK OR LIVESTOCK  PRODUCTS,
 AS DEFINED IN SECTION THREE HUNDRED ONE OF THIS CHAPTER;
   (B)  NOT-FOR-PROFIT  FOOD  ACCESS ORGANIZATIONS DEDICATED TO EXPANDING
 ACCESS OF UNDERSERVED, URBAN AND RURAL COMMUNITIES TO  HEALTHY,  LOCALLY
 PRODUCED FOOD;
   (C) THE GROCERY INDUSTRY; AND
   (D)  ECONOMIC  DEVELOPMENT AGENCIES SERVING COUNTY, NEW YORK STATE AND
 NEW YORK CITY GOVERNMENT.

   ANY VACANCY ON SUCH  TASK  FORCE  SHALL  BE  FILLED  BY  THE  ORIGINAL
 APPOINTING  AUTHORITY.  TASK FORCE MEMBERS SHALL RECEIVE NO COMPENSATION
 FOR THEIR SERVICES BUT SHALL BE  REIMBURSED  FOR  ACTUAL  AND  NECESSARY
 TRAVEL EXPENSES INCURRED IN THE PERFORMANCE OF THEIR DUTIES.
   2.  THE MISSION OF THE TASK FORCE IS TO IDENTIFY STRATEGIES AND OPPOR-
 TUNITIES TO EXPAND ACCESS FOR UNDERSERVED, NUTRITIONALLY DEFICIENT URBAN
 AND RURAL COMMUNITIES TO HEALTHY, LOCALLY  PRODUCED  FOOD  IN  NEW  YORK
 STATE.  THE  TASK  FORCE  SHALL  DEVELOP AND IDENTIFY NEW AND INNOVATIVE
 METHODS TO INCREASE THE PRODUCTION, MARKETING AND DISTRIBUTION OF LOCAL-
 LY PRODUCED, FRESH FOOD IN SUCH COMMUNITIES IN NEW YORK STATE.
   3. NOT LATER THAN ONE YEAR AFTER THE EFFECTIVE DATE OF  THIS  SECTION,
 THE  TASK  FORCE SHALL REPORT TO THE GOVERNOR AND THE LEGISLATURE ON ITS
 ACTIVITIES, FINDINGS AND RECOMMENDATIONS.
   § 2. This act shall take effect immediately and shall  expire  and  be
 deemed repealed December 31, 2023.
