BILL NUMBER: S2989 SPONSOR: FUNKE TITLE OF BILL: An act to amend the vehicle and traffic law, in relation to the licens- ing requirement of an individual acting as a transportation network company driver PURPOSE: Currently drivers with an out of state driver's license are only able to utilize ride-sharing services to pick up a passenger outside of New York State and drop them off within New York State. This bill would allow drivers with an out of state license to pick up passengers for trips originating and completing within New York State. SUMMARY OF PROVISIONS: Section 1. FUNKE, BOYLE, GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Trans- portation AN ACT to amend the vehicle and traffic law, in relation to the licens- ing requirement of an individual acting as a transportation network company driver THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subparagraph (iv) of paragraph (b) of subdivision 1 of section 1696 of the vehicle and traffic law, as amended by chapter 60 of the laws of 2017, is amended to read as follows: (iv) does not possess a valid [New York] driver's license; § 2. Subparagraph (ii) of paragraph (d) of subdivision 1 of section 1696 of the vehicle and traffic law, as added by section 2 of part AAA of chapter 59 of the laws of 2017, is amended to read as follows: (ii) The department may promulgate regulations authorizing additional LENS notifications as the commissioner deems necessary to protect public health and safety; AND, NOTWITHSTANDING SUBPARAGRAPH (I) OF THIS PARA- GRAPH, SHALL PROMULGATE REGULATIONS REGARDING THE RECEIPT OF NOTIFICA- TIONS OF TRAFFIC VIOLATIONS BY TNC DRIVERS WITH A DRIVER'S LICENSE ISSUED BY A STATE OTHER THAN NEW YORK. § 3. This act shall take effect on the ninetieth day after it shall have become a law. Effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date are authorized and directed to be made and completed on or before such effective date.
